House lawmaker moves to oust judge in deportation case with move that skips impeachment

An Arizona congressman introduced legislation Monday to remove the federal judge who has blocked President Donald Trump's efforts to deport Venezuelan gang members, offering a novel path that avoids the impeachment process and the need for two-thirds support in the U.S. Senate.

Rep. Andy Biggs, R-Ariz., filed a resolution that would remove U.S. District Judge James Boasberg for “failing to maintain the standard of good behavior required of judges" under Article III, Section 1 of the Constitution.

“Most Americans believe that there is lifetime tenure for a federal judge. That unless impeached, a federal judge can serve until death," Biggs told Just the News. "But lifetime tenure is not guaranteed, nor mentioned, in the Constitution. Article III, Section 1 permits a federal judge to serve only ‘during good behavior.’”

Good-considering how many lawyers there are in congress, there is no reason why every novel legal way to get these lunatic judges shut down shouldn’t be used...

Just have Blondi issue an arrest warrant charging the judge with giving aid and comfort to the domestic and foreign enemies of the United States. Then let Kash have this judge perpwalked right into the slammer.

May be hard to get 51 or even 50+Vance votes in Senate. House majority may also be hard. Zero Rat votes to be had with these targets although if they tried it on our judges they’d be all in. But if they can get close it tends to confirm Bigg’s procedure as legit and suggest worse behavior may result in success. Might evolve into a decent check on bad behavior if done well. And some additional kind of checks and balances on the judiciary are clearly needed. I’m glad Biggs is trying.

This is exactly why the Founders saw fit to provide Article 3 judges with life tenure. The failure of good behavior part requires proof during a Senate impeachment trial.

There are no shortcuts, if you care about the Constitution.

Boasberg will block it. LOL of course, but reminds us that the only way out of this is to simply defy the district courts and force a panicked Congress to repeal the stupid 1988 law that gave those judges’ rulings jurisdiction outside their own districts. Simple majorities can do that tomorrow.

I don’t want Republican judges, I don’t want Democrat judges, I want U.S. born judges who interpret current law, with regards to the Constitution.
We should not be subjected to their political, religious, or opinion related beliefs.
Purge the tyrants from both sides.
This is a start.
