Alan Dershowitz Predicts Fate Of Trump’s Venezuelan Gangbanger Deportation Effort In Supreme Court (VIDEO)

Constitutional attorney Alan Dershowitz said Wednesday the U.S. Supreme Court would issue a “divided” decision on President Donald Trump’s efforts to deport members of the Venezuelan prison gang Tren de Aragua (TdA).

A divided three-judge panel from the United States Court of Appeals for the District of Columbia Circuit upheld a temporary injunction by United States District Judge James Boasberg of the District of Columbia issued March 15 that ordered the Trump administration to turn around two planes carrying members of the Venezuelan gang to El Salvador. Dershowitz said the Supreme Court would likely hear the case, but that neither side would claim a total victory.

“The United States Court of Appeals for the D.C. Circuit Court, on which I clerked a hundred years, ago, not quite but 60 years ago, 62 years ago, something like that, affirmed the lower court decision not to permit any more airplane flights with deportees to go to El Salvador,” Dershowitz said. “The decision was two to one with the Trump-appointed judge dissenting on procedural grounds and the other two judges saying ‘Yes, you can. You can keep that stay in effect or nobody gets deported anymore in the way that these Venezuelans got deported.'”

Did they go through the Federal process of coming here legally? No they didn't. They violated that Federal process, and broke the law. They don't deserve due process.

Does he mean a leftist law firm representing each individual thug with deliberate delaying tactics and pleas for time to gather more documentation being granted, then appeal after appeal?

Our system overwhelmingly favors the guilty and sets up the innocent victims and the new ones for more harm.

That's a good point. Not to mention that taxpayers pay those leftist law firms to represent those illegals, and drag those cases out, which means they get paid far more than is necessary.

I also don't understand why people who come here illegally, and are still citizens of another country, and still have allegiance to that country, are required to be given due process under the U.S. Constitution. They are criminal enemy invaders. The only thing they deserve is having their asses shipped back home.

One way around the "due process" dilemma is to treat these illegal invaders badly enough that they'd WANT to be deported.

They may be entitled to due process, but that doesn't mean they can't be detained. In fact, they are flight risks by definition so there presumably is no bail in their cases (at least under this President).

So let their lawyers engage in all kinds of delaying tactics. While all this is going on, keep the invaders in custody without any comforts. A penal colony in Puerto Rico or Guam sounds like a good option.

That's the legal question: How much process is due a person who enters the country illegally? Some people might inadvertently wander across the northern border, and someone could get shipwrecked or blown off course navigating in a boat. People crossing the southern border know they are entering the country illegally, and most all are economic migrants. The real problem is that we have elitists on the courts who object to economic migrants being deported, and don't care that many who entered the country illegally are criminals. It's fair to call them unpatriotic and opposed to the rule of law.

I got a feeling that’s what’s going to happen.

It’s tough getting around the due process ruling, so they have to be kept here until the due process runs out.

Whether or not they can be kept locked up for the whole process will depend on the judge handling the case.
