The Court of Appeals for the D.C. Circuit will hear oral arguments Monday on whether a lower court can properly address the Trump administration's efforts to deport Venezuelan nationals via a 1798 wartime law.
The administration asked for a stay pending appeal shortly after an initial March 15 order was issued, calling it a "massive, unauthorized imposition on the Executive’s authority to remove dangerous aliens who pose threats to the American people."
The Trump administration had attempted to invoke a 1798 wartime authority to deport Venezuelan nationals, including alleged members of the gang Tren de Aragua (TdA), for a period of 14 days.

Judges Karen Henderson, Patricia Millett and Justin Walker will preside over the Monday oral arguments. Two of the three judges were nominated by Republican presidents, with Henderson appointed by President George H.W. Bush in 1990 and Walker by Trump in 2020.

As I understand it, this was an emergency appeal, though the article doesn’t explicitly say so. Given that, the ruling could come quickly—possibly even today.
seeing how venezuela would not accept them back we had to do something...i dont care to pay for their incarceration beyond what is necessary
I guess I’ve missed it but why can’t they be deported by ICE just like any other illegal who gets caught. Why can’t they be sent to Gitmo.

I concur we need due process to determine whether an individual has the privilege of living and working in the United States of America. Once that status is determined, how the invader is shown the door is up to the Executive. It's a civil matter, right?

That’s precisely what the judge in this case is saying - due process wasn’t provided to the accused, nor was any evidence of criminal gangs membership submitted to the court.
We could have already been rid of these people if there were enough immigration courts active.
If these guys are part of the illegal immigrants & particularly part of TrenDeArgurua they need to vacate America quick enough to make their heads swim.
