Live updates: Trump counters judge’s order by carrying out deportations for hundreds of immigrants

Over the weekend, the Trump administration transferred more than 200 immigrants to El Salvador even as a federal judge issued an order to bar the deportations temporarily.

On Saturday night, District Judge James E. Boasberg ordered the administration not to deport anyone in its custody over the newly invoked Alien Enemies Act, an 18th-century declaration that has only been used three times in U.S. history, all during periods of war. Trump issued a proclamation that the 1798 law was newly in effect due to what he claimed was an “invasion” by the Venezuelan gang, Tren de Aragua. Flights were in the air at the time of the ruling.

On Monday, plaintiffs filed a lawsuit to halt the deportations and asked a federal judge to force officials to explain under oath whether they violated his court order.

The law wasn’t repealed, it is still on the books, it can be used. Compared to the AG using the Enron laws to prosecute J6 protestors it’s not a big deal.

He hasn’t ruled on anything yet. I presume is justification is that if they are deported then if any ruling comes into effect there is no way to reverse the deportations. He asked them to hold off 14 days to hold a hearing. I presume the issue at play may have to do with due process.

This is one side saying they have they don’t need to use due process to evict criminals and terrorists, they want to move fast. The other side will try to slow it all down by claiming all defendants need to have hearings determining their status (which could take years).

...which such case, Marbury v. Madison, is also limited by Jurisdiction Stripping should Congress so act. I don't think the Senate is required.

The answer is that the judge got his power upon his confirmation. They stretch their power until someone reverses them. They proclaim the law until a higher judge tells them that they erred in their proclamation.

It’s part of the MSM narrative that Trump defied a court when he really didn’t. The planes were already 90% of the way there when the hack issued his order.
