MI AG Nessel: Musk’s DOGE Is ‘Illegal, It’s Unconstitutional’

Michigan Attorney General Dana Nessel said Thursday on CNN’s “OutFront” that Elon Musk’s Department of Government Efficiency (DOGE) is illegal and unconstitutional.

Host Erin Burnett said, “A group of 14 states tonight just filing a new lawsuit against DOGE, arguing that Elon Musk’s ascent to power in the Trump White House is unconstitutional.”

Nessel said, “It’s a clear violation of The Appointments Clause, right? You know, the United States Constitution, it grants the President of the United States the ability with advice and consent of the Senate, to appoint cabinet secretaries and directors over particular agencies. But Elon Musk in DOGE, which falls within the branch of The Office of Management and Budget, um, he doesn’t have the power to be marauding through all of these various different departments and agencies of government.”

Well the US Digital service has been an agency of govt for some time and nobody questioned it until Trump renamed it DOGE. Now suddenly its unconstitutional. 🙄

Hey Nessie: Try Johnson vs Mississippi from 1867.It said a court cannot interfered judicially when a PRESIDENT is doing his ascribed duties. And as the CEO OF THE GOVERNMENT which is exactly what any PRESIDENT IS he can do it. The 1867 court said any attempt to stop what he is doing cannot be justified legally. IN otherwards NESSIE. a judicial attempt to interfere with the performance of such duties would be “an absurd and excessive extravagance.” The Court noted that if the President chose to ignore the injunction, the judiciary would be unable to enforce the order.from that 1867 case which has not been overturned!lex

Democrats would love to see Trump lose his cool and defy the order.
I don’t think he will.
Trump needs to have a conversation with John Roberts and convince him to put an end to this absurdity.
