The Biden administration doesn't get to rewrite Title IX on a whim.

Big win indeed!

This is just a “Motion for Summary Judgement” that was denied. It is not a result of a court hearing on the facts of the case.

I hope the final result is against the Biden Administration.

My apologies, I read it wrong.

There was a “Motion for Summary Judgement” approved for the State of Tenn. It was only a denial of the Biden Admin’s petition for Summary Judgement.

That is very good.

I'm alone here, title IX is pure feminism. Women's sports are the only thing title IX benefits. Without government enforcement, women's sports would have to exist on their own merits. Which they wouldn'r.

Where is the womens NFL? HOCKEY? The WNBA would dry up and be gone if they didnt get money from the NBA. Womens college softball is something I pay to see, because they are good!!

even serina willaims said she would be wiped off the court by even a 30th ranked man.

Title IX is DEI for women.

It is basically a death blow to the Title IX rewrite. The Biden administration will be over in less than 2 weeks. The new Secretary of Education can withdraw the new rules altogether.

This ruling is important because it states that the rewrites were arbitrary and capricious thus putting the brakes on the federal agency’s overreach.

Winning at the summary judgement level is a big thing.

This just stops Agencies from overstepping the Congress.
Builds on guidance on new Anti-Chevron stuff.

A good thing.

Media is now starting to report on the ruling:

“Federal court strikes down Biden admin’s Title IX rewrite”

https://www.thecentersquare.com/kentucky/article_9ff2faaa-29f2-51b3-8a8d-2faae3282327.html

(The Center Square) – A federal court in Kentucky ruled Thursday that the Biden administration’s rulemaking expanding Title IX to include gender identity is “unlawful.”

The judgment from the United States District Court from the Eastern District of Kentucky sided with Kentucky, Indiana, Tennessee, West Virginia and private organizations and individuals. Critics of the rule lauded the court’s decisions.

Chief Judge Danny C. Reeves wrote in Thursday’s order that the administration’s final rule overstepped its congressionally given boundaries.

“Congress gave the Department authority to issue rules, regulations, and orders to effectuate Title IX’s prohibition on sex discrimination consistent with the objectives of the statute,” Reeves wrote. “However, the Department exceeded that authority in issuing the Final Rule and the text of Title IX shows why.

“Put simply, there is nothing in the text or statutory design of Title IX to suggest that discrimination ‘on the basis of sex’ means anything other than it has since Title IX’s inception – that recipients of federal funds under Title IX may not treat a person worse than another similarly-situated individual on the basis of the person’s sex, i.e., male or female,” Reeves wrote.

Yes. I read it originally and only saw the Biden Administration losing their motion, in which case it would go to trial.

This is good.

A really good opinion. Sensible but also legally tight. The judge was appointed by W, by the way. Say whatever else you will about W, Chief Judge Danny Reeves wouldn’t have been appointed by Al Gore.
