Jordan Neely’s father sues Daniel Penny as NYC jury deliberates verdict for subway chokehold death

Jordan Neely’s father is suing Daniel Penny over his son’s chokehold death on a New York City subway car as the jury still deliberates whether to convict Penny of manslaughter.

The suit, filed in New York Supreme Court on Wednesday, accuses the Long Island Marine veteran of negligent contact, assault and battery that caused injuries and Neely’s death last year.

Neely’s father, Andre Zachary, “demands judgment awarding damages in a sum which exceeds the jurisdictional limits of all lower Courts which would otherwise have jurisdiction,” according to the lawsuit. It was filed Wednesday as jurors in Penny’s four-week-long Manhattan trial broke for a second time without reaching a verdict.

I’m beginning to think the only reason a certain percentage of people have kids. Either so they can get in on the big bucks doing sports or entertainment or get their asses killed so the family can sue and get the big bucks. This clown’s “son” was nothing but human debris. The court should award him a coupon for a Big Mac.

Neely will lose in NY civil court for sure, and will probably go bankrupt.

Don't shoot the messenger, I am just telling it like it is, even here in ruby red Texas, similar things have happened.

I was warned about cases like that while attending a self defense related class, you can be acquitted of self defense related criminal charges due to the high burden of proof, but lose everything you own in civil court.

Manhatten trial. Don’t hold out much hope for Mr. Penny. They have their own sets of laws and standards in NY. If Mr. Penny is convicted, every law-abiding person in NY should leave the state.

If the jury learns of this civil action while they’re deliberating, how do we suppose this may influence their decision?

Yes, they’ve probably been instructed to avoid the news, but what if...?
