WASHINGTON — Supreme Court Justice Neil Gorsuch will not participate in an environmental case being argued next week after reviewing the court's new ethics code, according to a letter sent on Wednesday to lawyers involved.
The letter from Supreme Court Clerk Scott Harris did not explain why Gorsuch was recusing himself, saying only that "consistent with the code of conduct" he had decided not to participate.
The move came after liberal groups and more than a dozen members of Congress urged him to recuse over his prior links to billionaire Philip Anschutz.

Rats never recuse. Ever. The only they will reuse is when them recusing will guarantee an appeal therefore a rat SC Justice will never recuse.

Nothing is ever permanent. Historically the court has been a very fluid environment...justices were added or removed many many times. Congress simply has to have the guts to do so. Nothing stops them from reducing the number to five or increasing it to 15, other than their will to do so.

Kagan did recuse herself once on a case in which she had previously advised Obunga.
Kagan refused to recuse herself a few years back. Guess she has more spine than Gorsuch.
