A federal judge has paused an attempt by the Biden administration’s Department of Justice (DOJ) to imprison Christian pro-life activists for up to ten years.
Judge Matthew Leitman, an Obama appointee, paused the DOJ’s FACE Act and felony conspiracy case against seven pro-life activists who are awaiting sentencing over a peaceful protest at a Michigan abortion clinic, citing the results of the 2024 election and the potential for the next presidential administration to handle such cases differently.
“As further discussed on the record, the Court will conduct another status conference during the week of March 24, 2025, to receive a report from the Government trial team as to whether there has been any change in the Government’s position with respect to the continuation of this case and/or with respect to the positions expected to be advanced by the Defendants in their post-trial motions,” Leitman said in a Nov. 19 order obtained by Breitbart News.
Steve Crampton, senior counsel for Thomas More Society and a lawyer involved with the case, told Breitbart News in a phone interview that Leitman ordered for the case to be revisited 60 days after Trump’s inauguration, in spite of the government’s objections, to see whether the DOJ had implemented a new policy or not.
“I would say it’s pretty unusual in my 40 years of practice. I’ve never seen it before,” Crampton said, when asked if a judge pausing such a case in an anticipation of a new administration is out of the ordinary.

Asst Atty General for Civil Rights “Kristen Clarke” alleged discriminatory practices
CV NEWS FEED // Lawmakers confronted Assistant Attorney General for Civil Rights Kristen Clarke over her department’s allegedly discriminatory practices during a House Judiciary Committee hearing Tuesday morning. Leading the charge was Chip Roy, R-TX, a former U.S. attorney who stated in his opening that in that role “my job was to equally enforce the law. Justice is blind and we must follow the facts wherever they take us,” Roy said. “Like all components of the Justice Department, the Civil Rights Division is expected to do the same: equally enforce the law. Unfortunately, under the Biden administration this has not always been the case,” Roy stated:
“The Civil Rights Division has fixed its sight for example on those charged with protecting us – police departments – often harassing these departments to the point where they cannot do their jobs. There have been a series of investigations … eleven times over the last two years we’ve seen a significant disparity. These investigations represented just a “few examples of how the [Department of Justice (DOJ)] Civil Rights Division have targeted those who protect our communities.”
“In the midst of rising crime, plummeting police recruiting, open borders, mountains of Fentanyl, the DOJ is prioritizing investigations with small- to mid-sized police departments,” the congressman said. He stated that Clarke’s division was “using the law to advantage or disadvantage certain states and individuals.”
Roy also challenged Clarke’s and the rest of the Biden administration’s interpretation of the controversial Freedom of Access to Clinic Entrances (FACE) Act. He noted that this law “protects abortion clinics, pregnancy resource centers, and houses of worship alike.”
“However,” he continued, “the division of prosecution under the FACE Act shows a significant bias toward prosecuting FACE Act violations involving abortion clinics.” In making this point, Roy specifically referenced the case of pro-life activist Mark Houck. The lawmaker also stated that the leak of the Supreme Court’s draft Dobbs decision “gave rise to widespread demonstrations and attacks on pro-life facilities. In fact following the leak, more than a hundred pro-life facilities were vandalized or damaged including by arson,” he said. “Two hundred eighteen Catholic churches have been attacked” since the Dobbs leak, Roy added, citing CatholicVote’s violence tracker.

The Biden Justice Department’s Kristen Clarke, assistant attorney general for civil rights, will be hit with three ethics complaints and a criminal referral, The Daily Signal has learned.
Article III Project is filing both the ethics complaints and criminal referral, which calls upon Attorney General Merrick Garland to open a criminal probe into Clarke on the grounds that she “knowingly and willfully” made “materially false statements” and that she committed “perjury.”
“There is ample evidence to support this referral for false statements and perjury,” Mike Davis, founder and president of Article III Project, said in the criminal referral. Davis’ organization is focused on defending constitutionalist judges, opposing radical judicial nominees, and pushing back on “radical assaults on judicial independence” such as court-packing.
The filings follow an April 30 report from The Daily Signal revealing for the first time that Clarke hid her arrest for a domestic violence incident and its subsequent expungement from investigators when she was awaiting Senate confirmation to her high-ranking Justice Department post.
Her ex-husband, Reginald Avery, has told The Daily Signal that Clarke attacked him with a knife, slicing his finger to the bone, while they were married in 2006. That record was later expunged, The Daily Signal confirmed.
