Judge allows death penalty if suspect accused of killing four college students in Idaho is convicted

The death penalty is only applicable in Idaho if the perpetrator is convicted of first degree murder or conspiracy to commit first degree murder. A jury also has to unanimously agree to impose the death penalty.

The judge overseeing the trial of Idaho murder suspect Bryan Kohberger on Tuesday ruled that prosecutors can seek the death penalty if he is convicted of killing four college students in August.

Kohberger is accused of killing college students Madison Mogen, Kaylee Goncalves, Xana Kernodle and Ethan Chapin by fatally stabbing them in an off-campus home in Moscow, Idaho, in November of 2022.

Defense attorneys for Kohberger, who has pleaded not guilty to the murder charges, tried to convince District Court Judge Steven Hippler to rule out the death penalty last month. The lawyers argued that capital punishment goes against "contemporary standards of decency," according to Fox News.

Hippler on Tuesday said capital punishment is constitutional, and that the defense did not come up with an alternative method of execution in Idaho, per NBC News.

The Daily Mail had this categorized as a “bombshell” that Kohberger would be subject to the death penalty for killing four people.

Why wouldn’t he?

The alternative to the DEATH penalty is life in prison WITH A CHANCE OF PAROLE after at least (a mere, IMO) 10 years. It should be life with NO parole.

indeed ... but i’m assuming that means Idaho does not HAVE life with NO parole as a possible sentence for any crime ...

I don’t live far from Moscow, Idaho and have been there. Nice little town with friendly polite people. So this case almost felt personal. I want the perp to die ASAP in the most uncomfortable way possible.

I like your piece by piece idea.

He and his lawyer have been fighting the death penalty saying it is arbitrary and unconstitutional.

Kohberger’s defense argues in the documents that the aggravating factors are “unconstitutionally vague,” and Idaho doesn’t provide much guidance on a “lesser penalty” that doesn’t include death.

Kohberger’s defense team is fighting against capital punishment, arguing that the firing squad method of execution is a “cruel and unusual punishment,” NBC News and Fox News reports.

That’s what I assume, so if he is found guilty of butchering those 4 kids, there is only one appropriate sentence & it’s not the one that has parole.

This is a moral failure. Death penalty ought to be mandated unless, and only if, there are overriding factors (e.g., mental — not drug — mental). No taking it off the table before trial.
