Woke DA's outrageous 5-word reason for not seeking death penalty for Laken Riley's killer

The 'progressive' district attorney who prosecuted the case for the migrant who brutally murdered nursing student Laken Riley said she wouldn't seek the death penalty because it would cause 'collateral consequences to undocumented defendants.'

Jose Ibarra, 26, was convicted Wednesday on all 10 counts for his brutal slaying of the 22-year-old Augusta University student while she was jogging and got life in prison without parole.

Many Republicans were shocked that Ibarra, an undocumented migrant from Venezuela, was not given a death sentence.

Deborah Gonzalez, a liberal prosecutor funded by George Soros, said in February that her office would 'no longer seek the death penalty' because life without parole already constitutes 'very substantial punishment.'

Gonzalez made several other 'soft-on-crime' policy decisions out of a desire to impact 'the community's fundamental faith in the system.'

That included not charging simple marijuana offenses, not using mandatory minimum sentencing and taking 'into account collateral consequences to undocumented defendants.'

She was forced to step down from the case and appoint a special prosecutor after being unable to get convictions. She's also previously been slammed for dismissing charges against a child rapist who was later convicted of the attack and even her own former supporters believe her to be incompetent.

She lost her re-election campaign to an independent by 20 points in November.

Riley's body was found less than an hour after she was reported missing, near a lake on the University of Georgia campus

Georgia State Senator Colton Moore demanded the Attorney General Chris Carr file an emergency motion to demand the death penalty and slammed the Democrat prosecutor in charge of the case, Deborah Gonzalez.

I was wondering why they weren't seeking the death penalty, why he pled not guilty, and why he asked for a trial by the judge. This answers one of the questions. The prosecutor was defeated for reelection.

He should have gotten a firing squad or should have been dumped in the ocean off the coast of his home country.
US taxpayers shouldn’t have to foot the bill for criminals dumped on us by foreign countries.

I watched most of the trial and was not aware that the prior DA had taken ‘a capital murder charge’ off the table. Then as I read many FR postings about the trial and FReepers commented about the prior DA’s actions.

Once again, FR is a good source to get the background.

Yes, and since I did watch the trial, the evidence was more than sufficient to have sentenced Jose Ibarra to death.

Decades of Supreme Court cases extend constitutional protections to undocumented immigrants. For example, in Wong Wing v. United States, the Supreme Court held that non-citizens convicted of illegal entry could not be imprisoned to hard labor without Fifth and Sixth Amendment protections.

The Supreme Court agreed. According to the Court, “deportation is an integral part—indeed, sometimes the most important part—of the penalty that may be imposed on noncitizen defendants who plead guilty to specified crimes.” And Texas courts agree that “a general warning of some adverse immigration consequence is not sufficient.” Instead, “plea counsel must tell the defendant that she will be deported.”
Since the nation’s policies on immigration enforcement have brought more non-citizens into criminal court for illegal entry and illegal re-entry, the need for criminal defense counsel to advise their clients of the adverse consequences of a criminal conviction have has become critical. And yet the exponential increase in non-citizens confronting criminal convictions has resulted in less process and the inadequate advisement of rights that is going without remedy. Thus, large numbers of non-citizens’ immigration status is being impacted without their true appreciation of the consequences of resolving their pending criminal cases.

Yeah, this is part of the problem with the current situation. Even if they sought the death penalty, it would be like 20 years before he was executed. Should be executed within the year like in the old days. Of course should never have been in the country.

Being in for something like this, one can hope he won’t last long in prison.

This guy was housed in the Roosevelt Hotel, which used to be a fancy hotel in NYC. He was then convicted of something. Then the US government paid to send him to Georgia.

Keeping this SOB behind bars will cost about $25K to $30K a year.

The good news is when some of his fellow inmates DO NOT LIKE SOBs who murder young women and, once the word is out, he'd be wise to be on full alert in the showers or exercise yard!
