Police shot and killed then 35-year old Douglas Zerby on Dec. 12, 2010 believing -- mistakenly -- that he was holding a gun. Zerby was actually holding a nozzle to a water hose

This is an old story but this POS Long Beach chief of police who ORDERED THE EXECUTION OF THIS MAN FOR PLAYING WITH A GARDEN HOSE was just named Chief of Police in Los Angeles. He and every person involved in this Murder should still be sitting on DEATH ROW where they belong.

He was sitting on the back porch of a friends house playing with a garden hose nozzle and the Long Beach Police under ORDERS of McDonald lied in wait and EXECUTED HIM WITHOUT WARNING. For a FRIKKIN GARDEN HOSE in an ENCLOSED BACK YARD.

A argument that could be made if he was out in the street waving the object at someone.

Not a real good argument when someone is quietly sitting on a back porch playing with something.

“LBPD Officers Jeffrey Shurtleff and Victor Ortiz shot Zerby as he was sitting on a step of an apartment complex in the Belmont Shore neighborhood playing with a hose nozzle. He was at the apartment to visit his friend. A neighbor had called police reporting that a man had a “six-shooter” gun in a backyard and was waving it around. Zerby was drunk with a blood alcohol content of 0.42 percent and was reportedly pointing the nozzle at the officers who arrived at the scene, according to authorities”

He’s somewhere that the caller didn’t know him. He was 5 times the legal limit of drunkeness. Caller told cops he was waving a revolver around. The drunken fool waved it when the cops arrived.

You make it sound like he was sitting there quietly fiddling with a hose nozzle. More air for me to breathe. Glad the cops were not charged.

Nope. The most useful thing he ever did in life was give his family that amount in a settlement. That far exceeds the value of his life’s expected earnings.

We will never know but it could have happened many cops have been ambushed Los Angeles is a real danger zone for them.

One cycle cop was shot in the back when issuing a ticket.

This was not LA.

And they were fearing ambush by the guy they were sneaking up on who was quietly sitting on a back porch. Really.

Even if the guy had a gun and it was out they STILL had no reason to shoot him. He was breaking no laws.

The "we had no idea what else he might have done" BS is just that BS. I am not allowed to shoot people who are just sitting on back porches even if they are loud and annoying. So the poor wee timid coppies can not do it when they are sitting there quietly.

If he doesn’t drop it there is the risk is to high for all.

This was not LA. It’s SANTA ANA it’s part of it.

Yes. The cops should be in prison. The cops are only being dinged $5,000 each, and trying to get out of paying that. The cops wrongly murdered an innocent man that held no gun and was not an actual threat to anyone. Pure and simple execution. When I was young, sitting on a hillside with friends in a park, a friend tossed me his handgun to examine. I was young and stupid to handle it, while being drunk. I realize now that I could have been shot and killed by an idiot cop. Later I got wiser and examined friends' guns indoors and while sober. This poor victim had a water nozzle on a friend's porch.

They did not ask him to drop it. Highly likely he did not even know anyone was there.

Are we supposed to crawl around on our hands and knees unarmed at all times in case some cop decides we are a threat?

If they had told him to drop it and he did not there would be some justification. But they didn't.

Guy sitting on a back porch, holding something so... shoot him? Don't even attempt to communicate because "ah... it might be an ambush! Ahhhhh!"

Let me be clear about this, a soldier, in an active war zone, would not be able to get away with this. They would find themselves on trial for murder. Can we AT LEAST hold the police to as high a standard as we hold an 18 year old in a war zone?

Pointing a weapon at someone should be reserved for times when a life could be in danger. Shooting should be reserved for times when someone's life IS in danger.

they were less than 15 feet away in the neighbors back yard looking through the fence. if you can’t tell the difference between a REAL GUN and a Water Nozzle, you should NEVER be around any type of weapon.
