Questions about marriages performed by woman at heart of Bridgeport absentee ballot case

Former Bridgeport employee Wanda Geter-Pataky is in the news once again. But this time, it’s for something she’s doing in New Haven.

Geter-Pataky is also a justice of the peace, and there are questions about weddings she officiated. Specifically, weddings allegedly involving non-citizens and whether they were meant to get around immigration law.

Video from the New Haven Independent allegedly shows Geter-Pataky officiating one such wedding recently at New Haven City Hall.

“Here's this woman who is at the center of a statewide absentee ballot scandal coming in with five, 10, 15 couples at the time to rush them through a process to get married,” New Haven Independent founding editor Paul Bass said during an interview.

NBC Connecticut independently obtained copies of 114 licenses from marriages Geter-Pataky officiated during a 30-day span ending Oct. 15.

Most licenses show one applicant per couple was born outside the U.S. and doesn’t have a social security number, indications they may not be U.S. citizens.

These occurred while she was on paid leave for her Bridgeport city job because she’s accused of absentee ballot fraud in both the 2019 and 2023 mayoral races.

She was arrested over the summer on charges stemming from the 2019 race and has been accused of wrongdoing in the 2023 race in complaints submitted to the State Elections Enforcement Commission, or SEEC.

Geter-Pataky was also captured on camera stuffing a number of ballots into an absentee ballot drop box during the primary for the 2023 race.

She was fired earlier this month. When reached for comment today, she hung up.

Mayor Justin Elicker (D-New Haven) said the Elm City has seen a rise in out-of-town, including non-citizens, getting married there.

Wanda Geter-Pataky found a way to supplement her income while on paid leave from her Bridgeport city job of 20 years and facing criminal charges for ballot fraud:

Bring in out-of-state non-citizens and conduct marriage ceremonies for as many as 100-plus Americans a month at New Haven City Hall.

One recent day, for instance, Geter-Pataky conducted seven such marriages in New Haven City Hall. All seven involved an Indian-born spouse and an American-born spouse. None came from New Haven, according to their marriage licenses. They claimed they live in Houston, Waterbury, Queens, the Bronx, Long Island, and Chesapeake, Virginia.

I have researched this topic extensively over many years as I specialize in divorce law from a tax perspective. I’m retired now, but was on the Divorce Committee with the state CPA and Bar associations, presenting at conferences on this topic many times over the years.

This is a legal issue, not a tax issue. However, it has great tax consequences.

The answer is different in each state as this is a state law issue that comes down to the requirements for a person to perform LEGAL marriage ceremonies in the state. This is also jurisdictional, as a person legal to perform marriage ceremonies in one state may not be legal in another state.

I attended a wedding ceremony for a friend of mine that is a judge. Another judge performed the ceremony. These were senior state judges, however the actual wedding ceremony was in another state. When the judge went to file his marriage license in the county office, they would not accept it as the judge performing the ceremony, and signed the marriage license, did not have jurisdiction in the state of the ceremony. The judge had to get married again in his home state for it to be legal.

Another issue is to determine if foreign marriages are legal in the USA. I’ve known couples who were married overseas years ago, use the same last names and have teenage children together, but do not claim their marriage in the USA.

The nightmare question is if the mail order clergy certificates qualify a person to perform marriages. In many states there are court cases which say NO. I personally know of many people who have been together for many years, have children together, and think they are legally married, but are not really married. They have no idea, and I’m not about to tell them.

I have assisted many clergy to become legal by helping them to affiliate with an organized church that holds regular services. The legal requirements to become clergy do not include an education or ordainment, as they vary by religious group. Much of my extensive research was to determine if they qualify for IRS Code Section 107 Housing Allowances. This is Federal Law and does not really apply at the state level.

Where this creates a big nightmare is if one party claims that there was no marriage years later at the time of divorce. I’ve testified as an expert witness in many divorce court cases over the years. The best I can say relating to the person named in the post above is “It depends upon CT state law.” I am not familiar with that state.

License to Get Married in Connecticut

If you are planning to marry in Connecticut, you must obtain a marriage license from the vital records office of the town where the marriage will take place.

What Are the Eligibility Requirements for Marriage?

Any two persons may marry in Connecticut so long as both parties to the marriage meet Connecticut’s eligibility requirements.

A person is eligible to marry if such person is:

Not a party to another marriage, or a legal relationship that provides substantially the same rights, benefits and responsibilities as a marriage, or one of the following exceptions are met:

the person is joined in a civil union and such person marries their civil union partner; or

the person is joined in another type of legal relationship that is substantially similar to a marriage, and such person marries the partner of such other relationship.

At least 18 years old, or the following exception applies:
the person is a minor that is at least 16 years old and has received authorization to marry from the probate court judge of the district where the minor resides.

Not under the supervision or control of a conservator, or the following exception is met:

the person is under the supervision or control of a conservator and such person has received written consent to marry from their conservator.

Not prohibited from marrying pursuant to section C.G.S. § 46b-21. C.G.S. § 46-21 prohibits persons from marrying their parent, grandparent, child, grandchild, sibling, parent’s sibling, sibling’s child, stepparent or stepchild.

Who is Eligible to Perform Marriages in Connecticut?

Judges and retired judges, including federal judges and judges of other states;

Family support magistrates, family support referees, state referees and justices of the peace who are appointed in Connecticut; and

Ordained or licensed members of the clergy, including persons who have been ordained through online ministries and who are given the authority to officiate marriages through such ministries.

There is BIG MONEY in arranged “not real marriage” marriages between American citizens and foreign nationals looking for “lawful” entry to the US.

Residence is not required. It is based upon the location of the Marriage License and ceremony.

Very informative post! I always thought the legal validity of a marriage was not a contentious issue and we had uniform laws across the USA for recognition of marriage. I was shocked about “The judge had to get married again in his home state for it to be legal.”

Interesting law in NC

Cousin Marriages:
First cousins MAY marry, but DOUBLE first cousins may not. Double first cousins are very rare, as the couple have to be related as cousins through both parents.

In Washington, D.C., anyone can pay $25 and fill out the one-page application to be authorized as a temporary officiant. The form consists of the name and contact information for the officiant and the bride and groom. It’s very easy to do. None of the parties are required to be residents of the District.
