Upper Leacock farmer Amos Miller cannot sell raw milk or dairy products made from it to the public under an order issued by a Lancaster County judge Friday afternoon.
Judge Thomas Sponaugle’s order also allows the Pennsylvania Department of Agriculture to inspect any location where Miller packages or distributes raw milk and to test Miller’s dairy products.
The ruling is a win for the agriculture department, which sought to prevent Miller from producing and selling raw milk and products while its lawsuit against him plays out.
But Miller’s California-based attorney, Robert E. Barnes, said the judge actually reduced the scope of the original injunction on Miller’s business.
Sponaugle’s order “only prohibits marketing and sale of raw milk products and protects family and noncommercial use,” Barnes said. The order explicitly says Miller can provide raw milk and products made from it to immediate family members.
The department sued Miller on Jan. 24, saying his business doesn’t have permits to sell raw milk or raw cheese, nor does it have a required retail license. The lawsuit followed a Jan. 4 raid on Miller’s farm in Upper Leacock Township, which in turn was prompted by two illnesses late last year, one in New York and one in Michigan, traced to Miller’s raw eggnog.
Sponaugle’s order comes after a three-plus hour hearing Thursday that centered on the dangers the agriculture department contends Miller’s products pose to the public.
At the hearing, several supporters testified that Miller’s products are necessary to them. Sponaugle’s order acknowledged that.

Unpasterized milk products can’t cross state lines. That includes international borders.
If we can put warning lables on cigs, lets put it on unpasteurized milk.

This is the story that exposes Absolute Corruption in the PA state and court system. Banana court does not begin to explain how corrupt things are in PA. Those courts actually break the law on a continuous basis and then they cover each others backs. In this case big AG went after Miller via the state and they kept losing. But every time they lost they they would just circle around again. Knowing that eventually they would win because the state and their courts are criminally corrupt to the max.
It will be interesting to see what Robert Barnes has to say on Sunday night with Viva.
It is time for the Revamped DOJ to go after these corrupt courts across the nation. Ensuring a uniform system of justice is a constitutional function of the federal government.

Not banned. A permit is required but it is free.
Robert Barnes lives in Vegas. He moved there from California years ago.
I bet the dems that control PA are going to use every onerous regulation on the books to make sure the Amish are “punished” a lot over the next few years for voting for Trump.

Yup Same guy. He has talked about these cases a lot. That is how I know how corrupt PA is. Big AG and the state have teamed up to prevent the Amish farmers from selling food. And it purely evil what they have done to get their way.

My family drinks raw milk when we can get it.
Nobody has ever gotten sick from it.
It does pay to know the producer and know that they are careful about not milking sick animals or animals on antibiotics.
Never understood this type of ruling.
The Amish obviously drink and eat the same food that they sell.
My Pop used to sell smoked sausage that we ate on our table and we had lista of waiting customers before hog killing season.
He made the mistake of putting an sign out and about two years later an FDA or some federal agency made him show where the smoked sausage was smoked and the freezer where the fresh was stored and told upon penalty of law to get rid of it.
Well, he did but to the costumers on the list and never put up the sign again.
He continued to sell his sausage until he died and my little brother did it for a while.
But just like our customers trusted us because we ate the same product we sold, so do the Amish!
