This factor in the case has probably been known all along, yet the prosecutor demanded Dan Penny sit locked up in jail all this time.
Merrick Garfinkel would never intervene. A white person defended himself and others against a black which is unacceptable in Garfinkel’s world.
I agree, however I'm failing to see how this changes anything for Penny. If the guy died then and there or a week later in the ICU it doesn't change anything. Or am I mission something?
Of course there have been political prosecutions as long as there have been prosecutions. But it’s important to remember that the ABA ethics rules, the CA rules, and I’m sure NY to define the primary duty of a prosecutor as not obtaining convictions but DOING JUSTICE. I couldn’t agree with you more that this is a miscarriage of justice of the first order

Thousands of people have leapt to financially support Penny, so he will not be losing money in this prosecution. It’s really about punishing an upright citizen.
Dereck Chauvin. The prosecutors refused to allow exculpatory evidence and the judge ignored it. The judge also forbade evidence and testimony that would have proven Saint Floyd was dead from bad health and drugs. Penny will get the same kind of trial. The evil judges in that s hole state will make sure he is another sacrifice to the altar of black fragility and vengeance.

The guy was screaming and threatening people. He was much more than just a “troubled homeless man”. That’s the kind of sick spin I’d expect from the NY Times. It’s a disappointment coming from the NY Post.
And as a side point, anyone in a liberal hellhole who chooses to step in and help had better first remember Daniel Penny.
