Brett Hankison retrial: Jury convicts former LMPD detective of violating Breonna Taylor’s civil rights

LOUISVILLE, Ky. —

A jury has convicted former LMPD detective Brett Hankison of violating the civil rights of Breonna Taylor during a federal retrial.

Earlier on Friday night, the same jury acquitted Hankison of violating the civil rights of Taylor's neighbors.

On the third day of deliberations in the Brett Hankison federal retrial, the jury told the judge they were unable to come to a unanimous decision.

This happened around 1 p.m. on Friday. The judge read instructions, or an Allen charge, for a deadlocked jury, urging them to try harder to reach a verdict.

They then went back to deliberate further. The judge told them to take as much time as they needed.

Wow. Empanel the jury and refuse to discharge them until they do what you want...

No structural error there, eh?

BTW, wanna reduce your chances of ever getting another jury summons...

Become a Trump donor.

That appears to work for any adult in the household.

Years ago, and I mean years ago I remember Rush Limbaugh saying that if you want out of jury duty to drop his name during the interview.

It worked I’ve never been called back since.

Rush said it’s because they want stupid women who watch Oprah all day

Just as it is your right to be tried by a jury of your peers, it is also your right to demand a bench trial (judge acts as jury).

I remember a law professor for first year college students saying that if you ever found yourself in court being tried for a serious matter, you should always demand a bench trial. Too many juries are composed of stupid people who are emotional (i.e. women) and can be easily manipulated. A judge will apply the law and weigh the strength of the facts alone (in theory).

Example: suppose you are accused of murdering your spouse but you are innocent. The evidence the prosecution has regarding the murder is next to nothing. But you had an affair. The jury will hear all about the affair and what a horrible person you are, and the jury will end up hating you and find you guilty based on that.

Myself and others get bounced off jury selection every time. Lawyers want dumb people who can be manipulated. I work in engineering and no engineer I know has ever served on a jury.

The last timeI was in a jury pool the lawyer for the defendant who beat up a neighbor stated: ‘This alleged assault...”

I shook my head from side to side.

She called me out by name: “Mr. Smith (not my real last name) why are you shaking your head?”

“What the defendant is accused of is not assault, you described a battery and are being untruthful to us.”

I did not make the final jury and have not been called back in 20 years...

BTW my GF was a well respected judge for 37 years here any my Uncle was the City Attorney for 17 years here as well...I guess I learned a few things by osmosis.

I was on a criminal jury trial a few years ago. Just for the heck of it I decided I would try to take over the jury. It was ridiculously easy. I got this little girl elected foreman. Then I called for a vote. One lady said she wanted to talk about it. I told her the judge told us to listen to the evidence and make up our own minds. She shut up. We voted guilty (the defendant was guilty), and got out of there is no time at all. No one pushed back even one little bit. It was funny and scary at the same time. I got the impression that people were glad not to have to really think.

I’m an engineer.
I served on a jury.
The perp was guilty as hell.
He even confessed, on tape, to a cop.
Yet, one woman refused to convict.
Until the remaining 11 persuaded her.

I was foreman of a criminal jury one time. First vote, 6-6. Asked who was most certain he was guilty. Little old lady said me. I asked why, she said he looks guilty. This was after a three day trial. We were hung for 5 hours, eventually 11 not guilty to her. (The guy was not guilty by the way). Finally she relented when told we were not leaving till there was a verdict.

One time I was removed during voir dire when the lawyer (I forget if prosecution or defense) asked “has anyone heard of jury nullification”. I gave a detailed answer and he made a smartass comment that I might be on the wrong side of the rail.

I am an engineer. I was on a jury. There were never any questions during selection about what I did for a living.

There was one question which seemed to be critical. "If the prosecution does not present any evidence, would you find for the defendant?"

I answered "Yes, defendants must be considered innocent until the State proves them guilty, beyond reasonable doubt". It was just a textbook answer from my high-school civics classes. I really thought the defendant looked guilty as hell and his lawyer looked like a movie-grade sleazeball. All superficial appearances, to be sure.

I was selected for the jury. Anybody that hesitated on that question was excluded.

And then, much to my surprise, the prosecution really had no evidence to produce. The original charge was based on obvious perjury and the lead witness recanted her testimony on the stand. The defendant was clearly innocent and in fact no crime had even been committed. I do not know why this case was ever brought to trial. It was a learning experience for me.

Even so, there was one juror who wanted to convict. She held out until after lunch, then realized that we would be called back the next day if we did not reach a verdict.

End result: Unanimous vote for acquittal.

Bad idea - they will just destroy more of middle America.

Better idea - Just eliminate nonconstitutional bureaucracies (ie: Department of Education) and severely downsize what remains.
