The Supreme Court of the United States will hear oral arguments Tuesday in VanDerStock v. Garland, a case focused on the ATF’s unilateral action to redefine what constitutes a “firearm.”
The case revolves around ATF Final Rule 2021-05F, which placed new controls on gun parts kits and firearms which Democrats describe as “ghost guns.”
A central part of this rule was redefining what the word “firearm” meant so as to designate “partially completed pistol frames” and other gun parts as “firearms.”
The ATF observed:
"Partially complete Polymer80, Lone Wolf, and similar pistol frames with any kind of indexing or material removed from the front or rear fire control cavities for installation of the trigger mechanism and sear, or slide rail attachments to connect the trigger mechanism and sear to the frame, have reached a stage of manufacture where they “may readily be completed, assembled, restored, or otherwise converted” to a functional frame. As examined, they are classified as a “frame” and also a “firearm,” as defined in the GCA, 18 U.S.C. § 921(a)(3)(B), and implementing regulations, 27 CFR 478.12(a)(1), (c). They are classified as firearms even if they are not sold, distributed, marketed, or possessed with any associated templates, jigs, molds, equipment, tools, instructions, or guides."

Ooops. I forgot to mention the time. 10:00 am.
I blew out my back by simply moving wrong and have a Dr appointment at 9:30. However, I thought SCOTUS watchers and those on the banglist might be interested.
I’ll catch up on the details when I return.
SCOTUS October 2024 term has begun!
Too bad this isn’t as simple as “it doesn’t matter, ‘shall not be infringed,’ so all such laws are meaningless.”
Good luck w/ your back. I know that problem full well.
Cheers. ‘Pod.
ATF should not even exist. The GOP should grow a set and defund, dissolve, arrest, prosecute and imprison the whole rotten bunch of them.
If this country lets the Democrats steal this election, let the confiscation begin.
Good luck w/ your back. I know that problem full well.
Cheers. ‘Pod.
Thanks. I sneezed this morning which didn’t help. I suspect you know how that is as well.
Yep. Sure do.
This is an interesting case.
What I suspect is the ruling will be 80% receivers will labeled a firearm, and taxed as such.
This argument should be considered in light of the Loper Bright decision and the ATF smacked down hard.
L
Ny has redefined air rifles to now be “firearms” requiring the same regulations as actusl firearms. (Ie no magazines over 10 rounds, no moderators unless you get a nearly impossible to attain suppressor license, and several other restrictions.
Ouch! Good luck with the dr appt and thanks for the ping.
“Supposedly” taking Tylenol and something like motrin together (max doses of each) “work as well as opioids” (although I tried it for severe pain after operation and found that not to be comp, etely true. It did help, but nowhere near like opioid did, but each person is different, so maybe the combo ndaids would work well for some)
Almost everything metal can be considered a “ghost gun.” I have somewhere an old photo of a pistol filed out of scrap railroad track, also an old article from the early 1970s GUNS AND AMMO magazine on guns made behind prison walls.
The movies often have “zip guns” in them.
“American Guerrilla in the Philippines” shows a slam fire shotgun for killing Japanese.
“Canon City” shows a prison break with prison made firearms.
Firearms have been made for years in small shops in India and Pakistan. Khyber rifles comes to mind.
Here are some I found.

Getting rid of the most obvious deprivations of American citizens’ liberties ... would go a long way towards restoring some respect for the judiciary
abolishing this horrible agency would be a great first step
Will there be some 79% recievers soon on the market?
Elizabeth Prelogar completely LYING to the court about ghost guns being used solely or primarily for crimes.
I would bet on that. Or something similar.
Still wouldn’t want to be the test case
