If I recall correctly. There was a supreme court case around the time of World War I, In which the Supreme Court ruled that a military draft is not considered a violation of the 13th amendment ban on involuntary servitude.
Of course, the Supreme Court nowadays, if faced with such a case, could overturn such a legal precedent.
Having been in the military, there are too many intricate technologies that require management and oversight by individuals who are fully willing to be there.
The "stick" is gone for too many positions. The "carrot" is all that's left, even if it's gotten rotten parts over the last two decades.
A country and military run by corrupt ‘elties’ isn’t worth dying for... that’s the reality behind citizens not signing up.
Once the right to vote was extended to anyone, versus land owners and members of the militia, citizens weren't going to serve in a militia for no reason and watch those who didn't serve vote the same as they did. Without the militia, the States and the Feds lost the right to call up militia members.
Exactly. For a multitude of reasons. 1. The way our legal system and courts are these days, one judge can stop it all.
2. The way mommies and daddies helicopter their kids into their 30s, there would probably be a lot that would accompany their kids to a theoretical boot camp.
3. The poor relative physical shape of today's young adults.
4. The lack of a law enforcement to round up people who don't show up. (Though the more I think of it, it is more likely that would haul in some white 20 year old from rural Kentucky than some illegal alien, so scratch #4)

The heavily bigoted and biased WWI era Court did, based on English common law and laws from before the 13th, but it would go down in flames today. Woodrow Wilson made the claim that it was not involuntary servitude because the national had “volunteered“ en masse when Congress declared war. He said it was merely selecting from a massive pool of volunteers. Hence the name, Selective Service. That sophistry simply would not succeed today.
Many WWI era rulings were long since abandoned.
It’s a clear violation. Its literally the very definition of involuntary servitude except as punishment for a crime.
