NEW ORLEANS (AP) — A federal judge has weakened the Biden administration’s effort to use a historic civil rights law to fight industrial pollution alleged to have taken a heavier toll on minority communities in Louisiana.
U.S. District Judge James David Cain of Lake Charles handed down the ruling Thursday, permanently blocking the Environmental Protection Agency from imposing what are known as “disparate impact” requirements on the state....
In its lawsuit, the state argued that the Biden administration’s plans went beyond the scope of Title VI.... The state also said the policy is discriminatory because it would allow regulation of pollutants based on the race of those affected. Cain agreed the EPA went too far.

The EPA has no authority to do anything except enforce the laws Congress passes. They can no longer make rules and regulations to impose on anyone or business.
A favorite theory of eco zealots is that capitalists locate toxic industries in black neighborhoods out of disregard for their health It indicts capitalists as racists. However, there are a thousand variables that explain the disparate health outcomes of blacks and whites. DNA and crime being the biggest ones.
Still trying to find where in that pesky constitution thingie that the fed was granted the power to regulate the environment.
It searched the constitution far and wide and then the courts miraculously “found it in the preamble under the “general welfare” clause
Which basically gave the federal government to power to regulate anything even crops grown on your land solely to feed your animals was somehow “interstate commerce”

This would have been a Hillary! "judge", and a victory for the EPA.
Interesting but will the guys in black dresses ever rule that wages are not income. and can be taxed freely but apportioned.
