Supreme Court partially reinstates Arizona voting law at RNC’s request

The Supreme Court on Thursday partially agreed to the Republican National Committee’s (RNC) request to revive an Arizona law that strengthens proof-of-citizenship requirements for voting.

The justices in a 5-4 vote reinstated a provision that mandates officials reject state voter registration forms if the person did not provide proof of citizenship.

But a majority declined the RNC’s demand to also put into effect Arizona’s separate prohibition on someone voting for president or by mail without citizenship proof, even if they applied using a federal version of the registration form.

The nation’s highest court partially granted an emergency stay Thursday that limits Arizonans’ ability to sign up to cast ballots without providing proof of citizenship. The pivotal decision could have major ramifications for the presidential race and voter registration laws in other states.

The news comes after state and national Republicans sought to enforce provisions of a recent state law tightening voter requirements. The case went to the U.S. Supreme Court for consideration after a federal judge blocked certain provisions of the law last year, sparking a series of appeals that so far have been unsuccessful. It is part of a larger legal battle raging in Arizona over voter registration laws during a key period before the November election.

The decision means voters who attempt to register without proof of citizenship using Arizona’s voter registration form will be rejected going forward, pending appeals in the U.S. Court of Appeals for the Ninth Circuit and any petitions for review. Voters who attempt to sign up to cast ballots using the federal form without providing proof of citizenship will still be registered. Previously, such voters could use both documents.

But the ruling rejected other aspects of the GOP application, including requests to block so-called “federal-only” voters from casting ballots in the presidential race, and to block those voters from casting ballots by mail. These voters will continue to cast ballots for presidential and congressional contests, but not state and local ones.

A conservative PAC should start running ads in both English and in Spanish warning non-citizens that it is a felony to vote in an election if not a citizen and anyone who does so could face criminal charges.

Yup. Arizona can continue to issue "Federal only" ballots to those who did not provide proof of citizenship when they registered.

Something tells me AZ won't be checking any votes.

It looks like illegals will still be allowed to vote for President, and their ballots will be subject to inspection. But that will not happen...

This looks pretty good.

The voter is warned that if they try this using only a federal form (the generic illegal is not going to know the difference state vs federal) then they will be exposed and either deported or will certainly lose the chance at future citizenship.

This looks pretty rare to me.

Precisely! And that in the face of a federal statute that prohibits noncitizens from voting in federal elections. Very sad day for America.

Barrett's dissent is amazing; it will be an interesting read if she has the courage to issue a separate dissenting opinion.

It appears you may be correct. Voting for the Commander-in-Chief, as with playing a role in hand-to-hand combat, may not be a place for females.
