Court ruling halts natural gas pipeline through New Jersey, New York

A natural gas expansion project spanning portions of New Jersey, Delaware and New York was dealt a legal setback after a federal appeals court vacated the approval of the Federal Energy Regulatory Commission.

The U.S. Court of Appeals overturned federal approval of the $1 billion expansion of the Transco natural gas pipeline, which would run through sections of New Jersey and Pennsylvania with extensions stretching into southern New York.

The panel ruled that the Federal Energy Regulatory Commission overlooked studies that the market for expanded natural gas in New Jersey was low when it granted approval last year to the based company's project to expand its pipeline.

"The record estimates enormous GHG emissions from the project for the next half century," Judge J. Michelle Childs wrote for the panel in a 33-page ruling. "FERC disclosed the estimated emissions and its Social Cost of Carbon analysis. But it then walked away from the relevant issues with a fatalistic shrug."

The move was praised by green groups, which filed the challenge and argued the project was unnecessary and would sharply increase fossil fuel emissions and worsen the impacts of climate change.

I think it is a danger to our nation to have climate cultists on the judicial bench.

Can we just cut blue states off from any gas (including that needed to provide electricity) and just let them freeze to death?

As with other issues, they want red states to produce what they need to survive since producing it themselves would affect climate change.

Don’t some of the people in those areas have to rely on propane or oil for heating? I have family on the southern tier of NY and their oil heating bills are astronomical. What a boon it would be to have natural gas in the area. I would bet the people making the complaints and getting them to court are able to rely on natural gas.....

The state of Hawaii is suing oil companies because of “climate change”. The oil companies should now in unison cut off the supply of hydrocarbon fuels to Hawaii.

Didn’t the Chevron decision make this all moot as the law was never written to require GHG emissions to be evaluated by the FERC?

Not exactly.

This will likely be appealed, and eventually corrected.

Congress now goes back to being responsible for correcting these activist judges by spelling out clearly what is and is not legal.

And, as intended, we (supposedly) choose the people in the Legislative branch to correctly write those laws.

US natural gas reserves, 12.7 trillion cubic meters.

US natural gas “production” (extraction), about 1 trillion cubic meters/yr

Will more be found? Yes, but that estimate is good quality and includes shale.

One hopes/presumes the pipelines in question will go from an LNG importing facility.
