Michigan has outlawed the so-called gay and trans panic defense, which allows criminal defense attorneys to use a victim’s sexual orientation or gender identity as a defense argument.
Michigan Gov. Gretchen Whitmer, a Democrat, signed House Bill 4718 into law Tuesday. The legislation states that an individual’s “actual or perceived sex, gender identity, gender expression, or sexual orientation” is not admissible in a criminal trial to “demonstrate reasonable provocation,” “show that an act was committed in a heat of passion” or “support a defense of reduced mental capacity.”

If some queer "dry humps" an unwilling bar goer, who then punches the queer out, the assaulted bar goer gets put in the "suspect" box as the criminal.

I’m assuming this doesn’t apply to race.
The separate race angle has been in place since the CRA of 1964.
Or to heterosexuals.
“If some queer “dry humps” an unwilling bar goer, who then punches the queer out, the assaulted bar goer gets put in the “suspect” box as the criminal.”
I always found that, “thank you, I’m not interested” works just fine. And, for the aggressive drunk, a pointed, “No!” also works. But the latter only happened once in seventy years as I tended to avoid places where I’d have to say that.
What if a lesbian is surprised by a chick with a dick? Does she have enough intersectional and trauma points to off him and walk?
Huh! Now, simple "prejudice" is criminalized? So, if a guy is on a dating app and answers the ad from some woman, but spurns the "woman" when he finds out it is a cross-dressing man, he's guilty of a crime?
We’ll, I’m talking about assault, as in a man rubbing his crotch ON YOUR BODY unsolicited and unwanted.
If you don’t punch the queer out, you’ve got problems. This is no different than a guy trying to rape you.
The queer commits assault and battery.
In Michigan, the queer also commits 750.520e Criminal sexual conduct in the fourth degree; misdemeanor.
I think the new law states that if a gay guy touches you, you press charges and put him behind bars.
Any criminal can take advantage of that.
Just pose as queer to rob and assault anyone.
Sorry, queer person. The guy you assaulted is in prison.
He will not bother you again.
I would think it was more related to trans people hoodwinking people.
Does that apply for a woman, too?
You are wrong on this. It was signed into law by a radical progressive.
Ask yourself...Why?
I will tell you why.
These mutilated and broken children will soon start taking revenge on their groomer parents, teachers, councilors and doctors. This law is meant to prevent their defense.
“We’ll, I’m talking about assault, as in a man rubbing his crotch ON YOUR BODY unsolicited and unwanted.”
Wow! Okay, never experienced that. But I was never really in a situation where something like that might have happened.
This new law gives him implied immunity. The victim is not allowed to object.
My apologies. I read the article wrong. I thought that it was outlawing the perpetrator from using gender or sexual orientation confusion as a defense. Admins can remove that if they want.
Perhaps the Criminal Sexual Conduct statute might still apply ...
That's definitely a big part of it.
There was a bar check at a famous "gay" bar in my city. Some of the drunken queers "dry humped" the officers. Nothing happened to the queers, and the cops were called on the carpet for responding to the assault.
