Trump’s Classified Documents Case Dismissed Over Unlawful Appointment Of Special Counsel Jack Smith

Judge Aileen Cannon dismissed the case against Trump, ruling that the appointment of special counsel Jack Smith was unlawful and violated the Constitution.

“The Superseding Indictment is DISMISSED because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution.”

The judge also ruled that Congress was required to appoint “constitutional officers” and the legislature was also needed to approve spending for such cases.

The judge issued a 98 page tsunami opinion when she ruled, expecting an appeal, and destroying it in advance.

Just watched a video review of her opinion - Jack Smith says she should allow his ‘appointment’ because congress has never denied an appointment before.

She has a pretty solid argument he was never ‘appointed’; and Smith’s arguments to Section 509 & 510 of US code only apply to current appointed attorneys

The process is the punishment, conviction, dismissal matters somewhat but Trump went through this regardless and that is what they wanted

The dismissal is a win, but they got a lot out of it, they will say dismissal is not innocence

That Garland, the top LEO officer in the USA and former candidate for SCOTUS, didn’t imagine that Courts would use this obvious argument when looking at a historical prosecution of a former President. In that case, he’s a total idiot

OR

He did know it, and proceeded anyway - because he was running a month’s long headline generating media psyop, and election-interference campaign?

Merrick Garland is still seething from his failed attempt to become a Supreme Court Justice. Mitch McConnell refused to take up Garland’s nomination after Justice Scalia passed away. McConnell has many negatives, but his defense of the Supreme Court, and the placement of 300+ Federal Judges during President Trump’s first term is crucial to the survival of the Republic. Even the 9th Circuit is now ruling in common sense and constitutional ways. It used to be known as the 9th CIRCUS because it was a most overturned Court in the land.

It is much more than that, I think. You do not become a far leftist committed to destroying the Republic over a slight.

My suspicion is he has been far left for a long time, and hoped to implement his notions while on the Supreme Court.
