NEW YORK — Donald Trump’s sentencing in his New York hush money case may be postponed from next week in light of Monday’s Supreme Court immunity ruling, with the Manhattan district attorney saying he is not opposed to a delay requested by Trump’s lawyers so they can seek to vacate his conviction.
The Manhattan district attorney’s office noted in a letter to the court Tuesday that sentencing would have to be delayed from July 11 for the defense to make its case about how the Supreme Court’s decision could affect Trump’s state court prosecution.
Trump’s conviction on 34 felony counts of falsifying business records was based in part on evidence of meetings and communications that occurred while he was president.
In a historic and far-reaching decision Monday, the Supreme Court ruled that presidents have broad immunity from criminal prosecution for official acts, and that evidence cannot be used to prove alleged private criminal activity if that evidence is part of a president performing his official duties.
New York Supreme Court Justice Juan Merchan has previously ruled that Trump’s conduct in the falsifying records case has nothing to do with his official duties as president, a decision Merchan made when rejecting a request by Trump’s lawyers to postpone the trial until after the Supreme Court’s ruling on immunity. The Supreme Court ruling was sparked by a different Trump criminal case, his federal election-interference trial in D.C. But it may impact his other cases as well.

manhattan da is not opposed to the motion
has bragg been told to back off?
Bragg is too busy letting murders and rapists out on no bail.
Hmm...Merchan sentencing him before the convention or after the convention? Not sure which one is best...he can use it as an opportunity to kill momentum going into the convention, or kill momentum coming out of it...
I thought this took place prior to the election. If so, immunity doesn’t carry.
I’m not saying he’s guilty, the whole trial is a sham.
I think they will may this as a convenient exit so they don’t lose on appeal. It’s an excuse.
The whole trial is a sham. I'm sick and tired of hearing "34 counts...". That is based on 34 installment payments, where checks were written out 34 times to cover the one large sum of "hush" money. So it isn't 34 things to convict him on, it's about one single thing.
And... the 34 payments were begun when Donald Trump was President in the White House, so the immunity does indeed carry because he was President when the so-called illegal payments began.
There should have been no conviction at all, innocent or guilty. And I believe Trump to be innocent, despite the 4-4-4 juror ruling (only a fraction of the juror pool convicted him). The trial was indeed a sham.
I had read that they used conversations, texts from President Trump, that occurred while in office, as part of the evidence against him. Not a lawyer, but I think, if they showed the jury ANYTHING that is covered by the presumption of immunity that the case gets tossed, period. Other thoughts from more lawyerly people here?
Yes the “evidence” was all collected during his presidency, therefore, immune. Toss the conviction out. And Fanny Packed as well. All of these harassment suits are null and void.
I don’t see a connection between the two cases.
I think they are just running scared.
Puzzled, but Bragg’s motive may be to push sentencing/confinement/jail closer to election and early voting.
I thought I read that it could be postponed for up to 2 weeks.
If the sentencing is delayed until after the convention, Trump won’t have to deliver his acceptance speech on zoom from Rikers.
(I thought I read that it could be postponed for up to 2 weeks.)
You read right. Here’s the letter from Bragg’s prosecutors to Judge Merchan.

😉👍
Bragg et al reading the tea leaves. Their sham trial had the opposite desired effect they intended. Sentencing or jailing Trump will only further hurt their cause now and they’re hoping for a save face way out of it to minimize how much they look like the fools they really are. Can’t have the Orange Felon gaining even more voters.
I don't like it, but I'm pretty sure that's how it'll shake out.
They want different timing for the sentencing.
I agree. I don’t get it
