Thomas uses Trump immunity ruling to question Jack Smith appointment

Supreme Court Justice Clarence Thomas tackled a question in his presidential immunity opinion Monday that Donald Trump’s attorneys didn’t bring before the nation’s highest court: Was special counsel Jack Smith legally appointed?

Thomas joined his fellow conservative justices on a blockbuster majority opinion that expanded the definition of presidential powers and narrowed the scope of Trump’s D.C. election interference trial. He also wrote a concurring opinion that delved into the separate question of whether Attorney General Merrick Garland violated the Constitution when he appointed Smith in November 2022 to oversee the two federal prosecutions of Trump.

Justice Thomas’ comments regarding Smith was clearly a message to Judge Cannon that he has her back should she decide to remove Smith from the case. Thank you Justice Thomas!!!!

Wait? Garland can violate the Constitution, which he swore an oath to uphold and defend, and nothing happens to him? Must be nice to be above the law???!

This completely bizarre and unconstitutional lawfare created by the Democrats in power must be stopped in its tracks and its creators punished.

Our country and its future depend on it.

"Huh? I didn’t see that ANYWHERE in the decision."

Thomas wrote a concurring opinion in which he questioned the legality of Smith's appointment. It was Roberts who wrote the majority opinion. Made no mention of Smith's appointment.

Indeed. The way it’s written It also an unequivocal signal to the hack judge hearing the DC case that she must address the issue

Justice Clarence Thomas also wrote the bill Biden & Co. used was out dated in 1999 to put Smith in action.

Color Jack gone trials may get shanked too.

The questioning of Smith’s appointment was long overdue.

Jack Smith’s appointment had been questioned prior to the Court’s opinion regarding immunity. It has been the subject of amicus briefs filed in the Florida case for one.

Also, the Opinion didn’t widen the scope of Presidential immunity, the Court simply confirmed the immunity that in the past had been the general consensus of all courts and legal scholars.

The Democrats wanted SCOTUS to apply a Trump exception to precedent and SCOTUS rightfully said “no”, not without a full case development, including briefing on applicable case law, and a determination of whether Trump’s action were considered within the scope of his official duties.

Since this is related to Jack Smith’s Trump persecution, I’ll just post it here.

MORE from Trump’s new filing in classified docs case.

Not only is the order of evidence in boxes seized at MAL not in original sequence, it appears the 15 boxes turned over to NARA in Jan 2022 also are not in original condition. Some boxes were “consolidated” before they were turned over to DOJ/FBI.

Trump’s team gave NARA the 15 boxes following months of harassment by David Ferriero, the Obama appointed archivist. Ferriero as early as May 2021 threatened to contact DOJ with claims documents had been destroyed—we now know Ferriero and his general counsel, Gary Stern, were in cahoots with DOJ and Biden White House by mid 2021 to concoct a documents case.

Now we are supposed to believe the contents of the boxes were SO SENSITIVE that someone at NARA “consolidated” them?

You want to hear something scary?

From X:

@CollinRugg

BREAKING: Hunter Biden is now joining White House meetings with top aides and his father after the disastrous debate performance.

According to NBC, White House staff members are asking each other: “What the h*ll is happening?”

Hunter is speaking with senior White House staff and his presence is completely blindsiding Biden aides.

“One of the people familiar with the matter said Hunter Biden has been closely advising his father since the family gathered this past weekend at Camp David after Thursday’s debate,” NBC reported.

“This person said Hunter Biden has “popped into” a couple of meetings and phone calls the president has had with some of his advisers.”

Joe Biden once referred to Hunter as the “smartest man” he knows.

We have a crackhead acting as an official President advisor. Hunter is afraid his father will screw up and forget to pardon him.
