Trump has presumptive immunity for pressuring Pence to overturn 2020 election

Former President Trump has presumptive immunity for pressuring then-Vice President Mike Pence to subvert the results of the presidential election in his favor by certifying slates of so-called “fake electors” on Jan. 6, 2021, the Supreme Court ruled Monday.

The determination came within the justices’ highly anticipated opinion on presidential immunity, in which they ruled that core presidential powers are immune from criminal prosecution. The decision returns Trump’s federal election interference case back to a lower court to decide whether his actions leading up to Jan. 6 merit the protection.

The assertions are false:

a) Trump never pressured Pence to certify alternate (not "fake") slates of electors. He asked Pence to delay certification so the states could investigate ballot fraud.

b) Trump and his team asked if it was possible to have states certify new slates of electors. The states would still have to certify them. But then we would have had two sets of electors and Pence and the House and Senate would have to choose which to accept.

There isn't anything regarding Trump about which these people will not lie.

The Hill writer got it wrong— it is NOT up to the lower court to ‘decide if it merits the immunity”— the immunity is described in detail as being a power the President retains. What the lower court has to decide is whether to dissolve the case BECAUSE the evidence used to make a case was illegal, and to determine whatever else in their case is covered by immunity, and thus-— there can be no furtherance of a prosecution. PERIOD.

What a stupid a@@ writer putting their own spin on the plainly written easy to understand syllabus and Decision and all Concurrences and Dissents therein. Arrogant jerk writer- doesn’t get it— the SCOTUS is not going to review their freaking case- they were responding to a Certoriari writ emergently presented to the Court.

What it means is...well....duh...you can spar with your VP...that's what he's there for...and with anyone else in your administration or connected to our government.

Remember the big stink when he got rid of Comey. Comey was so sure he got Trump when he said .......was a good guy.

I would add that the Framers clearly understood there would be contested elections and possibly multiple slates of electors which why the certification process is there to begin with.

We are governed by lying ignoramuses who think their job is to anoint whomever the pig-dog media deems President.

These are not “fake electors”, they are alternatives similar to JFK Hawaiian alternatives which had to be in place mid December. Luckily they were allowing Kennedy to win! I love how the press never allows the law or details to get in the way of a story tale…..

I saw the Psaki interview with Nazi Pelosi last night where by she claimed the USSC sat on the immunity decision for 6 months because they’re in cahoots with the Trump campaign. That silly slut apparently didn’t realize the SC didn’t even hear arguments on the case until the end of April. She lies with impunity but because of congressional immunity, she never pays the price. She doesn’t want Trump to have immunity, but it’s okay if professional politicians have it. Sounds like some ppl ARE above the law.

Tens of thousands and Trump asked Congress and Pence to “stop the steal”.

That was perfectly lawful.

The balloted electors have a duty to submit their votes if they reasonably believe or know their candidate won.

Mere state certification is not sufficient. People responsible for conducting elections might and should lose their jobs if found to be derelict in their duty. Such people might reasonably be thought to be capable of trying to pretend that there were no problems of significance.

There was and is considerable evidence that there was a significant level of election fraud in states as far apart as Arizona, Wisconsin and Georgia and that people running elections in Georgia were not as vigilant and diligent as desirable.

Congress might presume a state certification is valid, but it has the right and the duty to investigate further if circumstances like poor election process design exists.

We know there was election fraud.

We know the election process now allows for rampant fraud and the incentive for such fraud is great when the federal government spend around $40,000/year/voter.

People were right to ask Congress and Pence to carefully examine the vote counts of at least five states.

But that never happened.   President Trump never pressured VP Pence to overturn the election.   President Trump only wanted the Vice President to do his duty as the President of the Senate and send the elector slates back to the States who cheated.

Lying or stupid statement.

That was not Trump’s request at all. Trump’s request was to investigate, not overturn. Certainly, an honest investigation would have uncovered the winner, not overturned the election.
