Justice Alito Whacks ASININE SCOTUS Ruling Against Free Speech in Murthy v. Missouri
NewsBusters ^ | 6/26/2024 | Joseph Vazquez

It’s a bad day for free speech. The U.S. Supreme Court ruled Wednesday that the government may continue to pressure Big Tech companies to censor speech it disapproves of, and dissenting Justice Samuel Alito tore the outrageous decision apart.

The Court ruled 6-3 — with Justice Amy Coney Barrett authoring the Opinion — that the complainants lacked standing to file an “injunction against any defendant” because they failed to demonstrate “particularized” harm. Chief Justice John Roberts and Justice Brett Kavanaugh joined in the majority’s ridiculous position.

The Court’s explicit gaslighting as to the Big Tech companies’ independent reasons for censoring content was particularly galling. “And while the record reflects the Government defendants played a role in at least some of the platforms’ moderation choices, the evidence indicates that the platforms had independent incentives to moderate content and often exercised their own judgment,” Barrett wrote on behalf of the majority. The absurd implication here is that yes, the government was strong-arming the platforms, but it was ultimately the tech companies’ decision.

Alito went straight to the point in his dissent, joined by Justices Neil Gorsuch and Clarence Thomas: “For months, high-ranking Government officials placed unrelenting pressure on Facebook to suppress Americans’ free speech. Because the Court unjustifiably refuses to address this serious threat to the First Amendment, I respectfully dissent.”

I was dubious of Amy from the outset. I do hope Trump’s next picks are shepherded by someone other than McConnel next go around.

Seems like ACB, Kavanaugh and Roberts have formed a bloc now.

Gorsuch is a wild card. Usually, he'll vote with Alito and Thomas but every now and then, he likes to go solo.

If the decision does not demonstrate a valid constitutionally basis, it should be nullified and ignored and at some point overturned.

Again the Constitution only vests in the Supreme Court decisions over INDIVIDUAL CASES ANS CONSTROVERSIES, NOT national law.

Only Congress is constitutionally vested in making law, not the Supreme Court.

Fully agree. We all went to the mat for party boy Kavenaugh. He immediately stabbed us in the back. Can’t believe we have to live with those two idiots for another 30 years at a minimum.

Squish is the nicest thing I know how to say about her betrayal of everything our founders hold sacred. What sort of education did she have that they sucked her soul out through a soda straw. Kavanaugh is just proving himself to be the idiot frat boy that the Dermocract offered proof of.

There isn’t a wit of wisdom between the two of them.

Thank you for supplying the link to the actual opinion itself. So I guess that when the federal government conspires to suppress the speech of everyone who disagrees with them, the injury is general and not particularized.

Not one member of this majority seems to have any common sense.

And here is what Ms Amy herself wrote oblivious to the irony:

In 2020, with the outbreak of COVID–19, the platforms announced that they would enforce their policies against users who post false or misleading content about the pandemic. As early as January 2020, Facebook deleted posts it deemed false regarding “cures,” “treatments,” and the effect of “physical distancing.” 60 Record on Appeal 19,035 (Record). And it demoted posts containing what it described as “conspiracy theories about the origin of the virus.” Id., at 19,036. Twitter and YouTube began applying their policies in March and May 2020, respectively. Throughout the pandemic, the platforms removed or reduced posts questioning the efficacy and safety of mask wearing and the COVID–19 vaccine, along with posts on related topics.

As we now know all of this was a pack of lies coming from the governmnet itself.

I just read that 6-3 vote at SCOTUS, we need to revamp the Court
*************

The Dems already want to do that...THEIR way. As in packing the Court.

I think both of them have human trafficking involved in adopting their children and it’s used by the DOJ to influence the important decisions that advance tyranny.

And yet the left will still push the laughable myth that the SCOTUS is conservative, What-a-freakin-joke.

This reminds me of one thing we should keep reminding the left of.....

When the left says there is no evidence the 2020 election was stolen/fixed/interfered with....may I remind them that the FBI pressured social media companies to portray Hunters laptop as “Russian disinformation” even though the FBI knew that was not true.

We have read about people who said if they knew that laptop was real and Joe Biden was involved in bribe taking, they wouldn’t have voted for him.

That’s ELECTION INTERFERENCE AND THUS A STOLEN ELECTION!

They are cowards unworthy of the Americans who died to give them their freedom. All 6 kangaroo hack judges should be wallowing in a gulag.

Exactly the goal is to insulate politicians from the backlash of bad decisions. You will start seeing think tanks and government critics getting shut down by this tyranny.
