Judge Cannon grills attorneys on special counsel budget

Judge Aileen Cannon spent Monday morning in Florida questioning attorneys in former President Donald Trump’s classified documents case about the funding for special counsel Jack Smith‘s office.

Cannon’s questions came during a continuation of a hearing that began on Friday in which the judge heard arguments about whether Smith was lawfully appointed to his position as special counsel.

Trump’s defense team has argued the former president’s 40 charges of retaining national defense information should be dismissed on the grounds that Smith’s appointment was both unvetted and improperly funded.

Trump attorney Emil Bove argued on Friday that unlike almost every special counsel of the last 40 years, Smith was not previously a Senate-confirmed U.S. attorney. Smith was therefore not vetted by the Senate before Attorney General Merrick Garland appointed him, Bove said.

The hearings have been dense as Cannon entertains weedy legal theories about the constitutional provisions and statutes that govern special counsel appointments, according to courtroom reports.

On Monday, Cannon gave Smith’s team a “rough reception” as she examined the funding the special counsel had received through Congress, according to Just Security. Smith was in the courtroom for the hearing.

Cannon, a Trump appointee, did not appear satisfied by what she perceived was the Biden administration’s “limitless” funding for Smith’s office, saying it created concerns for her about the separation of powers, Just Security reported.

They want it both ways: They want to force Trump to take possession of classified documents, implicitly admitting he owns them, then they want to prosecute him for possessing the very documents they forced him to take possession of and implicitly admitted he owned.

As to the sophomoric argument that DJT47 needs gagged to prevent his rhetoric from causing his supporters to bear ill-will toward the deepstate, DOJ/FBI: show me one DJT47 supporter who doesn’t already have maxed-out levels of antipathy toward them.

Next case.

Judge Cannon is an improvement over kangaroo judges Merchan(A foreigner) & Engoron,(A weirdo) yet these nonsensical court cases continue to move forward.

If there was any justice in our corrupt & one-sided law system, these farces including the civil hit by Carroll would’ve never seen a grand jury.

No other President in US history has been vilified and persecuted like the 45th President.

These left-wing bastards have taken hate propaganda to a new & higher level.

Sure! 🙄 A lot of talk and no action! Until I hear her say there’s no case here case closed then I will say damn what a judge of honor and integrity! We’ve been down this road before with the DC backstabbing RINOS and the corrupt judicial branch. I’m not getting my hopes up. I’ll wait and see.

Judge Cannon can’t rush through any of that-she has to dot all the I’s and cross the T’s if she wants this to pass a supreme court challenge. She appears to know what she is doing-calmate...

Smith and Garland argue that there is ample statutory precedent but statutory precedent does not trump Constitutional authority.

"[S]he has surprised some legal observers with how much time and consideration she has given to Trump’s argument, as courts have already exhaustively examined other special counsel appointments. As Cannon noted Friday, they are governed by “well-defined” statutes."

What kind of crap journalist writes that? Those "legal observers" apparently think proper Constitutional appointment provisions can be glossed over by, "We've always done it this way" defensive claims, because past appointments were already active or former US Attorneys that had been presidential appointees, confirmed by the Senate, where Jack Smith was neither.

It's unavoidably--which author Ashley Oliver and her unnamed "legal observers" can't seem to fathom--a rather important distinction!

It's much better that she drags it out like this, instead of tossing it out and allowing Smith to go to the D.C. Circuit for relief. Keep this water torture going until November!

Democrats can do whatever the heck they want to do because the media approves and refrain from reporting it as Republicans whine.

Jack Smith/the Biden administration has directed every media outlet to do a hit piece on Judge Cannon this week.

Even WSJ, with has moved to the left since hiring a new editor-in chief recently, got in on the pile-on.

“As Trump’s Documents Case Crawls Along, Questions About Judge Abound”

https://www.wsj.com/us-news/law/as-trumps-documents-case-crawls-along-questions-about-judge-abound-aece6c11?mod=hp_lead_pos9

Check out the lede sentence:

“Trial in Florida is nowhere in sight as Judge Aileen Cannon gives the former president’s legal team chances to argue against prosecution”

(How dare she allow the defense a chance to argue?!)

Cannon is also a foreigner. She should have already ended this case, but she is an attention hog.

Wiki is not exactly a conservative site-but according to them:

“Aileen Mercedes Cannon was born in 1981 in Cali, Colombia. Her mother had fled Cuba as a girl, after the Cuban Revolution of the 1950s. Her father is from Indiana. Cannon has an elder sister. Cannon grew up in Miami, Florida, where she attended Ransom Everglades School, a private school.”, etc blah, blah, blah-so you may have the opinion that she is “an attention hog”-but she is not a “foreigner”.

The dem-biased press spreads enough lies and fake info about this whole legal fiasco without any repubs and Trump supporters adding any untrue insinuations to the whole mess...
