Interesting idea. As we await the Supreme Court decision, it does make you wonder about immunity for other presidents in other situations.

We should all be aware that Supreme Court decisions set legal precedence, which then will be applied in other cases in the future.

The question is really whether there is a "treason" or "bribery" case to make over the border.

Is Biden committing treason by opening the border to military age men from China and South America?

Is letting in foreigners and then illegally giving them voter registrations a form of bribery for votes?

Is the definition of "high crimes and misdemeanors" meant to include the willful disregard for faithfully executing the laws or using executive orders improperly to legislate from the Oval Office?

Of course, Democrats in the Senate would never support a conviction, but we have to change the behavior of Republicans to no longer convince themselves to do nothing because of the perceived futility of it.

Obama, Bush and Bubba should be thinking about this as well. Each could very plausibly be charged if a new precedent is set. They are guilty of taking payouts after they leave office for things they did while in office.

An expansive grant of presidential immunity will certainly help Biden for the next 7 months. He’ll be able to do nearly anything to undermine and block Trump and Republicans under that scenario.

President Nixon could have been convicted.

Presidents don’t have more (or less) immunity than their subordinates such as Hillary Clinton, General Eisenhower, General Westmoreland, Colin Powell, J. Edgar Hoover, Eric Holder, Merrick Garland or James Comey.

Presidents do enjoy a rebuttable presumption that their actions were legal.

Biden would argue it was an official act within his core responsibilities to open the border except that it benefited him personally by shoring up his political base so it would have to be left to the jury to determine his motivation and therefore his guilt. If he did it for personal reasons then it is a crime otherwise not. Only a jury of his peers in say Wyoming could make that finding of fact. Nobody is above the law and a Wyoming jury is at least as unbiased as a NY jury.

Obama droned US citizens in the middle east in what can only be described as extrajudicial executions. Does he need to stand trial? You bet. Nobody is above the law, not even sainted black presidents just ask Nancy Pelosi or Chuck Schumer...please for God’s sake someone ask them.
