Depends on the circumstances. There are fake guns that look very real...and when a kid is carrying such an object he/she should understand that ordinary people might be very concerned when they see it.

I'd look at any videos that might exist,listen to any eye witnesses there might be,and look at the shooter's...and the kid's...background if I was a juror in this case.

I saw a TV commercial this week about a nonlethal weapon - looks like a real weapon - red - don’t recall the name of it but looks like trouble for the same reason as this story....
