Is Special Counsel Jack Smith's office Constitutional? Unlike U.S. Attorneys, he wasn't appointed by the President and wasn't confirmed by the Senate.

Congress never even authorized a Special Counsel office to exist. We shouldn’t pretend this position is legal or independent.

Trump's Attorney has already challenged the legitimacy of Smith's appointment, which is under consideration in the Florida case, which is why they have not brought it to SCOTUS yet.

Meese and Mukasey mentioned it in support of the immunity case. It was not part of the appeal on Presidential immunity because it was mentioned in a different filing, but Trump's lawyers told Thomas they fully agreed with Meese and Mukasey.

They are not the executive branch. They don’t even control both houses of congress.

Sadly you are correct, but that had better change because it will filter down to them at some point in time. Some of those cheering now because it is happening to Trump, may rue that when it filters down to them personally.

What is not true about what I wrote? Only the first 3 are in current status. And they have represented him past tense. The actual hush money trial. And whatever Dersh has faced, I’m sure people on the other side have faced similiar. And that is a far cry from lawsuits. And my list is far from inclusive. Frankly, for one as aware & knowledgeable as you, how could you not know about those examples? Intentional? Lob an accusation and see if it sticks? You’ll notice that those who do have or has had legal problems are associated with the big lie. Even Rudy and Jenna have admitted to less than truthful in their work on that task. Should they not be held responsible?

Simply stated, absolutely nothing will happen to abhorrent creatures as long as the Democrats control the Senate.

Regardless of whether DJT wins a landslide victory against FJB, as long as the Senate is controlled by the Democrats they will prevent any investigations from occurring and changes PROPOSED by the HoR (assuming it is still in Republican control) from ever making it to the desk of the POTUS.

We have been and continue to be screwed . . .

The function of news media is to inform, but it’s used to hide things as well. How often has it been reported that Vladimir Putin has endorsed Joe Biden in the 2024 election? Correct there is no Constitutional provision of “special council.” Smith wasn’t nominated by President or confirmed by the Senate. It’a not possible for AG to create an office with more powers than he has himself
