The question remains unanswered: by what mechanism could the SC intervene?

In a post-Constitutional world, where laws are created out of whole cloth without legislative process, statues of limitations are discarded without a second thought, and violations of law are invented to criminalize a specific person because he is hated by a political faction, such questions are fairly moot.
