Multiple legal experts have cited multiple legal reasons why Trump’s guilty verdict is likely to be overturned on appeal.
I am listing some of their reasons here, but there are a lot more reasons at the links:
Judges are supposed to be chosen at random. But this judge was selected on purpose.
Judges aren’t supposed to make political donations. But this judge had donated to multiple anti-trump organizations.
The main crime that Trump was convicted of was a misdemeanor, and the statute of limitations had expired. However, the prosecutor updated it to a felony, and used some other crime to avoid the statute of limitations. However, the prosecutor never said what that other crime was. The judge gave the jury instructions that they did not have to vote unanimously when it came to this other crime. The judge gave the jury three separate crimes to choose from, and said they could split their vote, such as, for example, by 4-4-4.
The campaign finance law that Trump was convicted of breaking is a federal law, not a state law. The state has no jurisdiction in this matter.
Here are opinion columns from three different legal experts that explain why there are multiple legal reasons why the verdict is likely to be overturned on appeal:
Alan Dershowitz: “I was inside the court when the judge closed the Trump trial, and what I saw shocked me”
Jonathan Turley: “Bragg’s thrill kill in Manhattan could prove short-lived on appeal”
Elie Honig: “Prosecutors Got Trump — But They Contorted the Law”

That Appellate court picture is misleading. There are 21 judges on the appellate court.
If the appeals court wouldn’t do it, why would the Supreme Court do it? And the Supreme Court has mostly left-leaning judges.
It doesn’t matter because SCOTUS will overturn it due to it being federal jurisdiction long before those 5 black women have any say.
> Trump’s guilty verdict is likely to be overturned on appeal. <
Well, yes…if the appeals court was fair and not packed with vindictive Democrats. So as I see it, Trump’s only hope is the Supreme Court.
Best we can hope for if Trump loses to Biden is that Trump wins on appeal.
Then all the sick judges, court morons, and DA’s will have lawsuits agains them.
In 4 more years, hopefully the public wi see the left for who they are.
“My prediction is that the judge will likely try to actually send Trump to jail. The Trump attorneys will introduce a writ for emergency hearing to the SCOTUS. The SCOTUS will put the kibosh on the incarceration while they deliberate and then rule to overturn the conviction. I do not expect this to go through the appellate court”.
I agree. Very good thinking.
This is a test, and so far they are failing their own system.
This is will not end well Supreme Court if you continue to remain silent on this travesty of justice. For it's becoming abundantly clear that it is nothing but a vehicle used by powerful people to enact injustice. Without an iota of difference between our justice system & the justice systems controlled by dictators.
In fact, it becomes quite apparent that they too fear their fate if they act in accordance to the Constitution.
Has the military also been captured?
I for one want to find out if that is the reality. For only then will people have to face the reality of the situation, instead of pretending that all is well in our nation as far too many people do.
The Cartels are paying premium dollars to keep Trump from the Presidency. They need to keep Obozo/Biden in office so open borders will be guaranteed. This is a gravy train for the Dems. How else could the Dems bank $250 million into their coffers?
“And once again, SCOTUS is in no hurry to right these wrongs.”
That’s a very naïve statement. Trump was convicted three days ago. With one exception, the SCOTUS does not have the legal authority to do anything until Trump exhausts the state appellate process, which could take many months even with an expedited briefing schedule. The one exception is a writ of habeas corpus, but to petition the SCOTUS for the writ, Trump would have to be incarcerated.
The Biggie: Bragg connived to finagle campaign finance law in order to convict Trump;
<><>but the law Trump was convicted of breaking is a federal law, not a state law.
<><>Bragg knew very well the state has no jurisdiction in this matter.
SCOTUS will understand -- or rather, a 6-3 majority will understand -- that the democrats are attempting to convict and imprison the opposing presidential candidate on a legally specious charge.
SCOTUS will understand that this case is entirely fraudulent and that an attempt to imprison Trump on that basis immediately before an election would cross a line that must not be crossed on peril of civil war. Especially when the destruction of democratic elections is being done by a party clearly intent on effecting a color revolution across all domains.
The SCOTUS will also understand, finally, that the democrats are engaged in a systematic effort to delegitimize the SC, abandon the rule of law, and convert the courts into instruments of raw political power. SCOTUS may sound a clarion call and step unequivocally into opposition, knowing that the democrats would then move to neutralize the SC at the first opportunity. I would not be surprised if SCOTUS looked for an out.
The possible sidestep: if SCOTUS does take the case, it could note that Alvin Bragg's case depends on inflating a dead misdemeanor into 34 felony counts based on alleged but never charged underlying crimes. This is a simple principle, and the KISS principle applies in the world of soundbites and memes. You can't try, convict and imprison anyone on the basis of a box of shadowy allegations that are hidden in the closet and never tried in court.
I don't know the legal language to use here, but my layman's sense is that SCOTUS might rule that Bragg must actually indict and try Trump for the alleged underlying crimes for which he wants to imprison him, and that Trump is entitled to mount a full defense. SCOTUS might therefore vacate the original Bragg case for this rather fundamental procedural and constitutional mistake, remand the case for a new trial, and stipulate that Bragg must actually indict Trump for the underlying crimes rather than trying him by innuendo and in the court of public opinion.
A new trial could not possibly occur before the election -- and since the alleged underlying crimes are also garbage, there would probably be no new trial. TBD.
The smart move for the democrats would be for Kathy Hochul to pardon Trump, which would defuse the immediate crisis. That would give the democrats their talking points without forcing very dangerous decisions.
I just bought a i’m-voting-for-the-convicted-felon tshirt.
Good post.
Yeah, they’ll overturn it 5 years from now.
Good for you. They need it rubbed in their faces.
Thank you. 🙂👍
You are aware that a NY appeals court lowered them amount he needed to pay Engoron by 9 digits?
The appeals court should reverse the conviction. Will they? Don't know. When? Don't know.
