‘Intentional Misfeasance’ Makes Show Trial Conviction Ripe For Reversal, Legal Experts Say
The Federalist ^ | May 31, 2024 | M.D. Kittle

Leftist District Attorney Alvin Bragg’s show trial delivered the Democrat Party’s dream: A felony conviction against their most hated political enemy.

The prosecution and the trial also were also littered with legal landmines and “reversible error” that should make former President Donald Trump’s looming appeal a slam dunk, legal experts say.

Historical and stunning but not surprising to many who have closely followed left-wing lawfare in recent years, the 12 angry Manhattan jurors after two days of deliberations found Trump guilty on all 34 trumped-up felony counts against him. Judge Juan Merchan has scheduled sentencing for July 11, just four days before the Republican National Convention is slated to begin in Milwaukee, where the GOP is poised to again nominate Trump as its presidential candidate. He will face President Joe Biden in the rematch of 2020’s mess of an election. Trump also is facing the possibility of spending the rest of his life in prison, depending on the vindictiveness of a New York judicial system that has already proved to be quite vindictive.

But the appeals process is certain to stall any sentencing, probably until after the election. And there is nothing currently stopping Trump from continuing his third presidential run, even with the kangaroo court felony conviction cheered on by his incumbent opponent.

‘One of the Craziest Things’

Constitutional law expert Hans von Spakovsky says the conviction isn’t likely to stick, for an array of reasons. Chief among them: Merchan’s convoluted jury instructions, in which the Biden campaign-donor judge framed the jury’s deliberations in a way that, according to legal expert Jonathan Turley, “seemed less like a jury deliberation than a canned hunt.” Merchan told the..

GOP House Whip Tom DeLay eventually won his appeal, years later.

It did end his political career though.

Mission accomplished.

The jury appeared ready to convict regardless of what the judge instructed.

There are plenty of aspects to this case begging for appeal. It may take a run through a couple levels of appeal to get to a court that doesn’t want Trump strapped in the electric chair.

The appeals process should be worked out by April 2025.

Talk about “normalcy bias”. After the Democrats and their Manchurian president-in-hiding now in his third term just sent the country down the biggest rabbit hole ever concocted by perverse America-hating legal fornicators, the talking heads and all their followers on FR now have complete and utter faith in a thoroughly corrupted legal system to deliver what? A reversal on appeal! Of all things. You guys just astound me.

After seeing the real-time corruption of New York City judges, prosecutors, and jurists can anyone say they would not vote for secession from this corrupt race of people?

The South did the right thing in 1860; that is for sure.

I think the Dems are hoping for a Supreme Court reversal, so they can fund-raise on the need to appoint more Dem judges.

The judge needs to be stripped of any legal authority.

I’ve been saying that here for some time.

We don’t need to secede. We just expel NY and CA.

They operate outside of the Constitution, so there’s no reason to include them in the club.

The only thing that would shut the Dems up would be a 9-0 reversal.

It'll probably be 6-3 or 5-4 which will allow them to continue pontificating about "Trump's Supreme Court."

If they win the White House and the Senate in November, they will probably go ahead with their plan to enlarge the Supreme Court (6 new justices giving them a 9-6 or 10-5 majority on most decisions).

Lawfare has been with us since Nixon.
Trump is the first to refuse to back down.

I agree. So did Alexandr Solzhenitsyn:

"During my time in the camps, I had got to know the enemies of the human race quite well: they respect the big fist and nothing else; the harder you slug them, the safer you will be."

Yes...but it was also “ripe” for never being brought to begin with, ripe for immediate summary dismissal, ripe for a directed verdict of not guilty on multiple occasions, and ripe for finding of not guilty by the jury...even the imaginary case was not proven by the testimony - indeed, the opposite. None of those things occurred...not so optimistic the deck would not be stacked against him on appeal.

Trump needs to have his appeal to SCOTUS in hand in DC ready when Merchan is sentencing Trump just in case he orders jail. That appeal needs to happen immediately and SCOTUS needs to stay it immediately.

I don’t think the Democrats care if it’s reversed later. They got their conviction and I’ll bet they put Trump in jail in July right before the RNC convention. Speaking of the convention, I think the left will provoke riots so they can arrest and jail Republican delegates and party workers to disrupt the campaign right when they should be working to get people elected.

Those jurors were threatened… Convict or we dox you and possibly worse. They don’t even know what they convicted Trump of. What law number did he “violate”? Or is it a super secret “breaking the law” thing?

And they will continue to use the word “convicted felon” every report about Trump. It’s a complete farce but apparently the demons think it helps them in some way....

But the appeals process is certain to stall any sentencing

No it doesn’t. The defendant has to request a stay which can be denied by the court. See NY Crim Proc Law 460.40 et seq. Moreover, there is no right to bail pending an appeal. See Gold v Shapiro, 63 A.D. 2nd 62, 65.
