Trump Closing: Bragg Fell Way Short, Offered Little Evidence of Scheme

Former President Donald Trump’s lawyer told jurors Tuesday they “should want and expect more” from prosecutors who claim the presumptive GOP nominee engaged in business fraud to boost his first run for the White House.

Defense attorney Todd Blanche, in his closing argument, said the state’s evidence showed little more than standard business practices.

“President Trump is innocent. He did not commit any crimes, and the district attorney has not met their burden of proof, period,” Mr. Blanche said as Mr. Trump’s hush money trial neared its conclusion.

A racist lynch mob, crazed by 6 years of hype and fear from the Obama-Biden administration’s massed news media, is not a rational mind.

Then again, MLK and Nelson Mandela were also jailed by a racist lynch mob.

The jury will still find Trump guilty. Jury instructions by Judge Merchan give the jury so much leeway that they don't even have to think there was an underlying crime that caused the misdemeanor expired statute of limitations charge of falsifying business records to be turned into a felony, in order to convict on the felony.

Donald Trump's ex-lawyer predicted this week that the former president will be found guilty in his ongoing criminal trial in Manhattan, citing the jury instructions given by New York Supreme Court Justice Juan Merchan.

On Tuesday, former White House lawyer Ty Cobb spoke with Morgan Chalfant of Semafor about Trump's ongoing criminal trial where he is accused of making hush money payments to former adult film star Stormy Daniels in 2016.

"If the jury begins deliberations Tuesday afternoon, expect a verdict no later than Friday afternoon. I expect a "GUILTY" verdict, but only because the jury instructions as urged by the DA and adopted by the judge, over strenuous and well founded defense objections, virtually require conviction," Cobb said to Semafor.

"I reach this legal conclusion because of my long experience as a federal prosecutor and white collar defense lawyer, my reverence for the rule of law, and despite my view that Trump remains the greatest threat to Democracy in our nation's history," Cobb added.

The jury must believe he committed an underlying, to the records keeping charge, crime. BUT, per the jury instructions, they do not have to be in unanimous agreement on which of three crimes he committed. If all 12 pick at least one of the three crimes to charge him with then he is judged to be guilty of committing an underlying crime.

“In New York, the bare-bones crime of falsifying business records is a misdemeanor. But it becomes a felony if the defendant falsified the records with the intent of furthering a separate underlying crime. Prosecutors have charged Trump with felony-level falsifying business records and have three theories to show a separate underlying crime. The first two theories argue that the Daniels payoff constituted an illegal contribution to Trump’s campaign in violation of federal and state election law, respectively. The third theory alleges that Trump intended to violate New York tax law by inflating and falsely characterizing the reimbursement to Cohen to manipulate its tax consequences.”

They are all New Yorkers to whom DJT is a demon. Acquittal or hung will mean the end of their families, friends and swell dinner parties. Sense? If they had any, its long gone.

I've actually been in New York City quite a bit. And even in Manhattan the majority of people don't even pay attention to politics. And there are a lot of people who aren't diehard Democrats. And that goes more for Brooklyn and Queens. Not to mention Staten Island. And how did they sell so many copies of the New York Post? Yet somehow they found a jury that was all people who think the same way? If anything, I think the upper class people who are more likely to be die hard Democrats are not likely to serve on juries. Do you have a demographic makeup of the jury?

From what I read, Jurors 1,2,3,4 seem mostly likely to acquit. But I don’t accept the premise that everyone who is a Democrat would vote to convict.

Unlike Perry Mason reruns, Trump's team didn't have unlimited disqualifications during jury selection, and the jury pool wasn't the friendliest to Trump to begin with.

I never said they had unlimited qualifications. But neither did the prosecution. So, Trump's lawyers couldn't pick the whole Jury, but they are supposed to be able to have some impact. Plus, as I said, I've been to New York City. Not everyone there is even interested in politics. And somehow the New York Post and Wall Street Journal sell many copies.
