That was pretty much the DOJ’s position in the recent SCOTUS arguments on Fischer. The DOJ solicitor practically told the justices the DOJ wouldn’t bring charges unless the Defendant was guilty. (Those aren’t the exact words but close enough).

The DemonKKKrats make up their world of illusions much like the Heaven Away crowd who took a walk out on the Santa Monica pier to catch a ride into space on a alien ship traveling behind the Hal Bop comet. When that failed, their objective changed to get as many as possible to don their black long-sleeved shirts and black sweat pants, with new black-and-white Nike tennis shoes. Then, take their barbiturate phenobarbital mixed into pudding or applesauce and lay down in their bunk bed to spiritually get picked up by the mothership.
