Perhaps FEDerally restricting abortion but not passing laws that say there is a federal Constitution RIGHT to abortion that constrains the states’ right to govern the issue. Just sayin’.
We’re talking about two different things here. One is a federal ‘ban’ on a method of killing (essentially delivering a baby at-term but killing it on the way out) and a ‘concept’ that this USSC held in the Roe v Wade reversal that it isn’t a ‘constitutional right’ or the federal government’s purview to be legislating “that which should be left to the states.”
The fact that a lickspittle GOP House, a Democrat Senate and a Democrat President could pass some national abortion legislation that would legalize abortion ubiquitously still has to get by the USSC and its recent reversal of Roe v Wade and turnback to states rights.
