It all came down to a single phone call that Cohen said took place between him and Trump and that purportedly established that Trump directed Cohen to issue the payment to pay off Stormy Daniels. But phone records obtained by the defense proved that the call, as described by Cohen, did not happen.
If Judge Merchan refuses to grant a motion to dismiss for some concocted reason of wanting to hear what the defense has to argue, President Trump should demand an immediate hearing before the New York State Court of Appeals for violation of his 6th amendment right to a speedy trial.
There is no valid reason for Merchan to keep a trial going if he knows the prosecution failed to prove the furtherance of another crime that justified bringing the expired misdemeanor bookkeeping charges to trial. Forcing Trump to put on a defense in a case that is past the statute of limitations would only be to keep him in court for punitive reasons, which is what the 6th amendment speedy trial protection was intended to prevent.

No, the prosecutors didn’t know.
They thought they did, but they were stupid.
If it made no difference who testifies, then prosecutors wouldn’t care who testifies.
But prosecutors put very intense efforts into these arrangements.
In this case, the prosecutors were caught off guard. They failed, and they failed big.

This group of prosecutors are trying to damage Trump.
But what they’re accomplishing is to increase Trump’s standing in the eyes of the public.
Besides general stupidity and other intellectual deficits, a flaw these prosecutors suffer is in failing to understand that the population of regular Americans holds massive amounts of power over them and over all other government officials.
The prosecutors certainly cared who testified when they dropped Karen McDougal from the witness list after Stephanie Clifford's disaster of a testimony.
And they must have had doubts about Cohen's testimony if they brought in rookie New York Democrat Congressman Dan Goldman (who represents Brooklyn and lower Manhattan) to coach Cohen's testimony.

I am pretty sure that’s illegal in my state. Maybe Cohens property is different.
Guys like Trump should be able to hire a a rogue biker gang or two to “sort out” the persecutors.
If the prosecution had doubts about Cohen, then they intentionally sabotaged their own case by putting him on the stand.
No, they didn’t have doubts. The fact is the prosecution failed massively.
Maybe even worse is Bragg creating this sh** show. Merchan has a chance to save his soul with a directed verdict of not guilty, or at least sane jury instructions.
