It is most likely a fact here that Trump has been the litigated target in history this past few years. As such the court IMHO needs to acknowledge this, unfortunately they will not bring up the lawfare issue.
Looks to me the court will take the lead of SCOTUS and go slow.

She wants the appeal to take place before the election because she knows the lawfare ends once Trump gets elected. The left’s appetite for it will be gone, and it won’t be as easy to find a judge willing to openly flout the law.
