BUT....

Section 702 is set to expire on April 19. But the program can continue operating until April 2025 because the FISA court last week granted a government request authorizing it for another year. Under the law, the surveillance activity can continue so long as there are active court orders allowing it, even if the underlying statute expires.

Don’t get excited its still in effect for another year....

Regroup for what?? That FISA needs to go away. It comes up for some of the most LAWLESS activities by our overlords. Let the bill go away. Don’t give them a backing for their lawless activities.

Has anyone else noticed how the DOJ/FBI very publicly revealed how they took down a homegrown ISIS operative in ID who was planning to hit the churches in Coeur D’Alene? I’d be more inclined to believe they’d let it happen to further their chaos agenda. This revelation is obviously geared toward getting their unconstitutional powers renewed through fear.

What don’t they get about illegally spying on innocent American citizens being wrong?

When FISA warrants were restricted to foreign subjects it was OK and needed. When Comey and crowd began including US citizens it violated the FISA law as written and no one called them on it. And the FISA judges knowing of the fraudulent applications continued to grant the warrants. We have a problem with FISA judges too.

We are in a battle to take over the Republican Party, not because it’s worth saving but because taking over an existing party infrastructure is an easier task than starting a new party.

I’d love for that mysterious “GOP source” to identify his or her name and cite statutory authority for the proposition that the FISA extension in the NDAA couldn’t be used to extend 702 collection until well into 2025.

Relevant statutory text within FISA, which became law through an amendment enacted by Congress in 2018, supports precisely the opposite conclusion.

A 702 certification by the FISA court (“FISC”) allows 702 collection to continue even after the expiration of 702, as long as the FISC issued the certification while 702 was still in effect.

Thus, the FISC could issue another year-long certification on April 11, 2024, and thereby allow 702 collection to continue under that certification until April 2025.

So not only does this language show we’re looking at a 16-month extension (rather than an extension of only four months), it also demonstrates that the 702 extension in the NDAA is completely unnecessary.

Why, then, would the intelligence community and its acolytes in Congress be so obsessed with passing this extension in the NDAA if it’s not necessary?

One must consider the possibility that it’s because they can get 16 months out of this — delaying this important, contentious, and necessary debate until well after the 2024 election — while convincing most members of Congress that they’re extending 702 for only four months.

FISA needs to be killed entirely. NO revised method. Unconstitutional. The US Constitution has not been put on hold.
