It’s actually the most sound constitutional position to take right now.

1. The underlying argument against Roe v. Wade by the “pro life” side was that abortion is NOT a Federal issue but should be addressed by the states. Pence comes across as a duplicitous moron when he makes a statement like this that UNDERMINES the successful legal argument that won the day in the U.S. Supreme Court.

2. A Federal abortion ban may very well be overturned in a 9-0 decision in the current Supreme Court that includes six justices who overturned Roe. See Item #3 below.

3. Except in rare cases, murder charges are adjudicated in state courts … because they involve violations of STATE criminal codes. I’d like Mike Pence to explain with a straight face why there should be a Federal statute to outlaw abortion when there is no Federal statute to outlaw the murder of a random school-age child anywhere in the U.S.

Am opposed to abortion on conscience and philosophical grounds.

Generally feel life begins at birth and also feel people should take personal responsibility for their actions.

That said, we have been granted free will by the Lord and your Constitutional analysis is sound.

Unfortunately we live in a society where that's about the best we can do if we wish to maintain a political viability to avoid an even worse outcome.

It's a good assumption that the abortion issue and some very ill advised political posturing on the abortion issue by prominent Republicans in Congress was incredibly damaging in the 2022 election cycle. That posturing led to losses for Republicans that have prevented any meaningful checks on the Biden Admins profoundly destructive agenda and has done profound, incalculable damage to both the anti abortion movement and the country as a whole

That's just the reality of the world we currently live in so we have to choose between bad and much worse

“”””. The underlying argument against Roe v. Wade by the “pro life” side was that abortion is NOT a Federal issue but should be addressed by the states.””””

I thought that it was just considered bad law by even many on the left and that it was inevitable that at some point it would be overturned, that it was based on a ridiculous finding of a right to privacy, and the Supreme Court can’t make law out of thin air.

I don’t recall the pro-life movement being based on the argument that abortion is a states rights issue.

1. The argument was always that the preborn child is a human life. The 5th & 14th Amendments require us to protect human life.

2. There is no way that would happen. As I said, rooted in the 5th & 14th Amendments.

3. See above.
