NYC squatters are cashing in on legal loopholes and crowded courts to take over homes — and good luck getting them out: experts

The Big Apple is seeing a troublesome trend of unwelcome squatters illegally bedding down in private homes and apartments in the five boroughs — and it’s gotten much harder to kick them out.

A backlog of housing court cases and changes in the law in recent years have made it a bigger and longer-lasting headache for landlords to boot unwelcome tenants..

“This is happening far more now than in the past.. Squatters have become far more sophisticated than before. They set up elaborate schemes, fake documents and investigate the homes before breaking in.”

Two changes in city law in 2019 now dictate that landlords can’t just boot a squatter without a “special proceeding,” and have to file a lawsuit to get them out.

The irony is the more publicity it gets the more people think about it,”

....

Goldberg said the term squatter is often misused — squatters are intruders who illegally break into a property and stay, while licensees move in “under color of law” and remain.

That can include relatives of deceased property owners or legal tenants who overstayed their welcome.

The problem stems from a loophole in the law that allows anyone who stays put in a property long enough to claim legal occupancy despite the landlord’s objection.

That cutoff is 10 years in most of the Empire State — but a mere 30 days in the five boroughs, making city property owners significantly more vulnerable to the unwanted homesteaders.

And no one is keeping track of how many there are.

NYC should be happy.. real estate is filling back up.

Getting squatters out is easy, grab some friends and some baseball bats if you don’t want to use guns.

I equate squatters to looters. If you are in my home or business without my specific consent, you are trespassing and stealing. In this situation, I believe the Castle Doctrine applies.

In days gone by, in NYC some goons from one of the 5 families would have strongly suggested to the squatters to leave or maybe their legs would get broken.

It’s going to come down to that again, locals will begin to take matters into their own hands when people start getting injured, no one will know what that happened.

Please explain to me how it’s getting harder to toss them out. Just go in and kick them out! They don’t belong there and any police force should back the people and not some liberal B/S law.
Who the F do these squatters think they are ?

“Elections have consequences and then everyone suffers the consequences”. even in Florida it took literally YEARS to finally pass legislation to stop this scourge on society. squatters are bullies. democrats say out of their collective mouths that they hate bullying and yet they not only support bullies but are themselves the consumate bullies. sad.

DeSantis solved this problem in two seconds in Florida yet Democrats in New York let it go on and on and on and on. Just a prime example of the difference yet morons keep electing them.

I’m glad I don’t own any real estate in NYC even though I grew up there. My temper would get me locked up and sued into oblivion if I had to deal with squatters. These squatters already killed a woman who came home to find them in her place, and they killed her. And STILL NYC will not do anything! And of course the media never mentions that this is ALL because of DEMOCRATS!

One of the few reasons to live in an HOA? then again the squatters would ignore the HOA and all the "letters of violation" and the home owner would be stuck with the fines.

short of violence or force of will by moving in yourself or hiring some one else to make their lives miserable, without law enforcement physically removing illegal squatters, what can you do?

You are now learning why the mob owned all the crematoriums in the mid 20th century.

If they squat successfully, they become tenants. Then you have to go through the multi-month process to evict them legally.

The only solution I can see for the good people of New York is to vote in more democrats such as Letitia James, Eric Adams, and Alvin Bragg. These type warriors will right the ship and get them what they deserve good and hard.

Except in some cases, the migrants will outgun the locals.

And MS-13 ain't afraid of the "five families."

Try that in a small town ……

I've been hearing this sort of conservative tough talk for 30 years. Yet things keep getting worse.

And with all the migrant dumps, "small towns" are turning blue, one by one.

“I believe the Castle Doctrine applies.”

I know many states have that in law. I wonder if NYS is one of them. If so, every squatter is fair game.

Re: 13 - had this happen in a county in Western NY several years ago, where some relatives live. Some meth heads broke into a house of some snowbirds who were in Florida for the winter. They were prepping the place to cook meth which essentially ruins the room in which they cook.

Some neighbors down the road saw cars one day in the driveway and called a couple of “friends” to check on the house. The friends checked in and the squatters said they had permission from the owner to live there. The squatters were told they had 1 hour to get out of the house while the friends waited there. Once they got their crap out, the sheriff was called and they busted the people about five miles away with already cooked meth from a previous house they had squatted at.
