I agree with his assessment. If SCOTUS rules this way it would basically follow the concept of qualified sovereign (employee) immunity. The question is whether Trump’s actions were in the normal course and scope of his position/employment .
What “actions” are you referring to that Trump did?
Isn’t enforcing election laws within the Presidential ambit?
Attorney Robert Gouveia Esq. has been saying for a long time, that the president has a legitimate responsibility to see that at least federal elections are free, fair, and accurate. The fact that he was a candidate is irrelevant.
“Trump’s actions were in the normal course and scope of his position/employment .
To which specific actions of Trump are referring prior to noon on January 20, 2021 that would not fall under immunity?
If it is the speech on January 6, 2021 be specific.
The truth is, Cernovich has less than NO idea what SCOTUS will or will NOT decide and the ONLY thing that such threads do, is stir up the pot.
I don’t know all that mumbo-jumbo but aren’t we supposed to be getting a ruling like tomorrow or this weekend from the SC over Trump being on Co ballot? Isn’t Tuesday super Tuesday and Colorado is included in this primary? I’m so confused I thought they would’ve ruled today? Hopefully will hear the outcome tomorrow or this weekend.
Most likely, the Supreme Court will not make a specific ruling as to Trump. Instead, they will lay out the basis for distinguishing between absolute and qualified immunity and remand to the trial court for further proceedings.
