If Trump is liable for “criminal acts” over the Jan 6 nothing burger, then Obama and Holder would certainly be liable for the fast and furious boondoggle.

In fact, before any supreme court ruling, those charges could be brought now by a State AG where someone injured by one of those guns was.

Knowing Roberts they will say a President does not have absolute immunity and it depends on the crime and situation etc. Thus punting it down the road

That’s not the way the SCOTUS works. It will not tale the James lawfare case until it is first reviewed by NY’s mid-level appellate court and its highest court. The SCOTUS rarely if ever takes an appeal directly from a trial court at the state level.

Wonder if they leg cramps from running toward their responsibility. Out of breath.

With primaries going on for months now and election officials needing guidance the SCOTUS wasn’t in a hurry to help. That is wrong.

SCOTUS will hear Trump’s immunity claim - but it’s absurd and they won’t buy it.

The “excessive fines” 8th Amendment case is a winner but it will have to pass through the NY courts first - there is no route of direct appeal.

I suspect the court will force states to put Trump back on ballot, and also will grant him immunity for any act that could even come close to be considered “official”. Strict scrutiny I think is the word. That doesn’t mean that Trump or any president can do ANYTHING with immunity, just that if the act “could” be considered part of their official duties as head of the justice department and executive branch they have to be given completely and absolute immunity.

ArtII.S3.5.1 Presidential Immunity to Suits and Official Conduct
Article II, Section 3:

He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.

In its 1867 decision Mississippi v. Johnson, the Supreme Court established that the President is largely beyond the reach of the judiciary by holding that it could not direct President Andrew Johnson in how he exercised his purely executive and political powers.1 The Court stated, it had no jurisdiction . . . to enjoin the President in the performance of his official duties.2

Agree.
The idea of keeping Trump off ballots when he has never been indicted for or convicted of insurrection is absurd.

So now he’s guilty unless and until he proves himself innocent like the old Soviet judicial system where it was assumed if the government went to all the trouble of assembling evidence to charge someone they are probably guilty. We’re close to that.
