The election board subpoenaed True the Vote to provide evidence that would assist it in investigating the group's ballot trafficking allegations.

In other words, True The Vote wasn't ready to present its evidence, or didn't trust Ratburger to act properly, or feared retaliation. They therefore asserted a journalist's First Amendment defense to Ratburger's attempt to learn of their whistleblowers. Ratburger went to court to find out what they know about his fraud operation.
