The U.S. Supreme Court will hear oral arguments this week on whether states can keep Donald Trump from appearing on primary election ballots for president based on the U.S. Constitution’s insurrection clause. More seriously, it could decide that Trump is ineligible to be president again even if he wins the November election.
We should hope for two outcomes: First, that the court does not use technicalities and procedural issues to evade a clear decision; and second, that it allows common sense and the fate of democracy to loom large in its decision.
The case before the court is an appeal of a December ruling by the Colorado Supreme Court. It found, “President Trump is disqualified from holding the office of President (and) because he is disqualified, it would be a wrongful act under the Election Code for the Secretary to list him as a candidate on the presidential primary ballot.”

I think that Trump should be awarded 1 billion dollars for every fraudulent legal action..
use technicalities means use the Constitution. Full of technicalities.
Triggered!
Yes. That’s why this decision wouldn’t surprise me.
If so...good. The nitwits should understand that this isn’t supposed to be a “democracy”.
Then Trump and our Nation is royally screwed.
These people are trying to say Trump committed insurrection. They then go on to say they can make this legal, without a trial or a conviction.
Such bad logic simply is unjust.
Everyone--even Donald Trump--has a right to stand before his accusers and defend himself.
Innocent (not guilty of a crime or offense) until (up to the point in time or the event mentioned) proven (demonstrated by evidence or argument to be true or existing) guilty (culpable of or responsible for a specified wrongdoing. See also find, plead).
In fact, how can one win or lose an election without a ruling from some authority to that effect? Where is the authority to rule he committed insurrection???
The whole thing is preposterous!
.
But this is a 6-3 conservative court so no worries.
Note to headline writer: It’s NOT a DEMOCRACY, It’s a CONSTITUTIONAL REPUBLIC. And I intend to keep it.
It should be tossed out with the fact he is not charged with insurrection.
So did I.
An amendment that details congress with changing conditions is a specific th8ng not under states’ rights.
TAKING the vote away from millions of legitimate citizens in the face of over 8 MILLION INVADERS could be the breaking point.
The more these nitwits bandy the term “democracy” around, the more convinced I become that they don’t give a rat’s a@@ about democracy, they’re just scared of being out of power.
We had a republic.
And that ship sailed three years ago.
It had to happen sooner or later:-(
Ok, it might be a bad thing or our “democracy”, but it would be a great thing for our Republic.
TheBiden regime frogmarched he Republic into the streets and shot it dead. What remains is fascism under the left’s muh dem-Ocracy.
2. Was the riot on January 6, 2021, an insurrection? Three contemporary courts have ruled it was: district courts in New Mexico and Colorado and the Colorado Supreme Court. The House January 6th Committee report refers to that day’s events as an insurrection 78 times. Several other congressional documents do the same.On top of that, throw in that twit Maine Secretary of State who also decided it an insurrection and tried to disqualify Trump and a similar move that failed in Illinois.
So for this author and the left, anyone can declare January 6 an insurrection for the purposes of declaring Trump ineligible to be President. Somehow, the same could not be done concerning the eligibility of Obama. Then it was a matter beyond mere mortals to decide.
