The predominant legal theory regarding Texas’ special status is that the original agreements made upon entry to the US were rendered moot by the agreements made by all Confederate states after the Civil War.
That said we are basically in a post constitutional America where political might makes right so who knows how it plays out.
Yeah, if the Ivy League dreamers in SCROTUS rule that way, the question will shift to
“So who’s the one who’s going to put the bell on the cat?”

That would mean that election fraud is OK, if you are the ruling party. That would mean that going after political opponents via spying, misuse of the court system is a valid use of staying in power.
Those things if they can be proven in a court and are ignored are what doom a democratic republic. Many people feel we are getting there, but I still have hope that the Supreme Court will take a long view.
