Federal Judge Blocks Calif. Law That Would Prohibit Carrying Firearms In Most Public Places

A federal judge has blocked a California law, that if passed, would have banned the carrying of firearms in most public places.

United States District Judge Cormac Carney blocked the law on Wednesday, stating that the ruling violates the Second Amendment of the U.S. Constitution and stops people from being able to defend themselves.

“[The ruling is] sweeping, repugnant to the Second Amendment, and openly defiant of the Supreme Court,” he wrote.

The law, which was signed in September by Governor Gavin Newsom (D-Calif.), was scheduled to go into effect on January 1st.

It would have made it illegal for anyone to carry a concealed weapon in 26 locations, such as zoos, churches, and public playgrounds.

Regardless of a person’s eligibility for a concealed carry permit, the prohibition would still be in effect. One exception would be privately held companies that display signs indicating that firearms are permitted on their property.

California’s Association’s President Chuck Michel released a statement, saying that the court “saw through the State’s gambit.”

Except in most venues in CA, you have to be a politician, celebrity, judge, jewel merchant, wealthy etc, to even get a CCW permit.

Used to be that way. Now, after the Bruen case (challenging NY’s licensing scheme) the Los Angeles city and county are no longer requiring “just cause” statements on the CCW applications. Just about anyone can obtain a CCW now. I don’t know about other blue CA cities or counties but I imagine if LA has dropped the ‘just cause’ (demonstrate an exceptional need) requirement most of the others would too. But maybe not.

Just need to be of good moral character, have some references, already own a firearm (max 3 on a permit), pass some safety and shooting training (was 8 hours, this new law made it 16 hours but not sure if that part was blocked by the ruling as well) and pay the fees. Oh, and get fingerprinted.

From a CCW lawyer’s website “Usually...an applicant is considered to be of good moral character if they pass the required background check and do not have any serious documented instances of poor judgment in their recent past. Of course some issuing authorities may use trivial incidents as a basis for denial.”

Obviously any felonies would disqualify. Maybe certain misdemeanors if recent like violence or public intoxication. I don’t know how deep a background check they go into, but if I had to guess it would just be mostly a criminal background check.

Depends on the county. The more rural counties approve more permits.

Hope ya never need to actually use it there. The juries are well known for hating white folk and most of the judges are leftist.

I find it interesting that the US Supreme Court found blacks were not citizens when they stated one of the rights of citizens was “To keep and carry arms wherever they went.”

Yup...openly defiant of the 2nd Amendment.There are at least several states that don't even try to hide that contempt. My home state (Massachusetts) is just about at the top of that list,followed by New York,New Jersey,Maryland,Illinois,Kalifornia...and one or two others.

I was able to get one in Orange County in less than 4 months in 2015. But I must have been lucky, some people were on a seven year waiting list.

Yes,I just picked up on that one quote.This is a very noteworthy and gratifying decision.Let’s hope it holds and let’s hope that Federal judges nationwide make it clear to state politicians that the words “shall not be infringed” are clear,unambiguous and very important.

Times have been changing. Placer county has over 7100 ccw holders. I am a nobody, with no political connections. I have had a ccw for 31 years.
