We’ll soon find out if there are any patriots left in the judiciary. What President Trump has endured is nothing less than a coup designed to rob the People of their right to choose their president. The end of the Republic is at hand. The Court can put a stop to this anarchy. Praying that they’ll stand up and save our beloved nation, or at least forestall its demise.
Consider that the Overturning Roe team may support the Unitary Executive.
Consider that Alito may be the one doing the strongarming -- not Roberts -- just as Big Sam, smacking down genocide in Dobbs, was able to reel in Beerman and Barrett, plus Gorsuch and Thomas, to produce a 5-4 Unitary Executive quashing of Hackschitt and some of the other cases floating out there (that 'immunity' would deeply compromise the government's case against archival lawfare).
BTW: I don’t see where the Supremes said yes. They just asked Trump’s lawyers to respond. Isn’t that normally what is done. Then the court will decide if they want to jump the gun or not.
Trump’s lawyers may say let’s do this thing, but I doubt it. They will most likely argue there is nothing that requires this to be settled early. The appeals process is good for them and the law.
I pray you are right. With a fair Supreme Court it does sound possible.

exactly. My concern is that if the mpotion is not heard en banc, that two lefty Justices like Kagan and Spotomeyer will be assigned to hear the motion itself.
I think only two or three Justices hear interlocutory motions.
That's plausible. I was just wondering; there has to be an upside to losing this crap shoot. Maybe it is simply the chance to leave the field with his butt in one piece. Jacksmith is good at starting things but not so good seeing them through.
That’s why I don’t think they’ll decide for Jacksmith; that would leave Obamas 1 & 2 open for the same.
In fact, maybe to press the issue, somebody in congress should call for an investigation into Obama’s ,fill in the blank, say the Awan server boys?
The Velvet Fascism of “Protect our Democracy”
THOMAS BUCKLEY DECEMBER 23, 2023
Deciding that a person who has not been charged with, let alone convicted of, insurrection is guilty of insurrection and therefore cannot run for president…that is “protecting our democracy” in action.
Whenever that term is used, one can be assured that the democracy they are referring to has no semblance to any actual democracy.

Jack (Smith) Not So Nimble

Those hoping that lawfare would give President Biden his best chance at reelection and pinned their hopes on Merrick Garland and Jack Smith making the magic happen, this has been a no good, awful, terrible week.
It seems clear to me that Jack Smith was appointed for the purpose of besetting Donald J. Trump and finding a means to keep him from running for president again. If I’m right, Smith’s many strategies have come to naught this week and it is extremely unlikely that the cases he instituted in the District of Columbia and Florida (meritless as I think they are) will ever be resolved before the election.
The case in the District of Columbia is being heard before Judge Tanya Chutkan. She indicated she wants to hear the case this coming March and has been firm about sticking to that. In one of her rulings in that case, she denied Trump’s motion to dismiss on the ground that he had presidential immunity from the crimes with which Smith is charging him respecting his objections to the 2020 election. That issue could have in the ordinary course of things been appealed to the next highest court, the U.S. Court of Appeals for the District of Columbia.
Such an appeal would have made it unlikely that the case would return to the District Court for trial and disposition before the election, so, in a Hail Mary move, Smith sought action by the Supreme Court to rule on the issue, bypassing the normal procedure. This week, without dissent or explanation, the Court rejected his request and the matter will be heard by the Court of Appeals. That court is predominantly Democratic and it’s more likely than not that it will sustain Judge Chutkan’s order. But it will take time...
