WI's Democratic governor sues Republican Legislature over blocking 'basic functions'

Wisconsin Democratic Gov. Tony Evers on Tuesday sued the Republican-controlled Legislature, arguing that it is obstructing basic government functions, including signing off on pay raises for university employees that were previously approved.

Evers is asking the liberal-controlled Wisconsin Supreme Court to take the case directly, bypassing lower courts.

In addition to not approving the pay raises for about 35,000 University of Wisconsin employees, Evers argues that the Legislature is blocking state conservation programs, updates to the state's commercial building standards and ethics standards for licensed professionals.

The Legislature included a 6% pay raise for UW employees over two years in the state budget it passed earlier this year that Evers signed. But pay raises also must then be approved by a committee of legislative leaders. That panel on Oct. 17 approved pay raises for state workers, but not UW employees because Republican Assembly Speaker Robin Vos opposes spending at the university for diversity, equity and inclusion efforts and positions.

Evers argues in the lawsuit that the Legislature is breaking the state constitution and separation of powers by creating “legislative vetoes” through which committees controlled by a few Republican lawmakers can block actions of the executive branch.

“Republican legislators are unconstitutionally obstructing basic functions of government—actions that have not only aimed to prevent state government from efficiently and effectively serving the people of our state but are now actively harming tens of thousands of Wisconsinites every day across our state,” Evers said in a statement.

The lawsuit argues that the state Supreme Court, controlled 4-3 by liberal justices, should take the case directly because of its significant statewide impact and the harm from blocking the pay raises, delaying programs and failing to achieve modern building standards.

Leftist lawfare!

Is the Wisconsin Legislature ready to impeach and convict the WI Supreme Court justices if they take the case?

Or will medical science have to perfect testicular and spinal transplants first?

Totally ineffectual. BUT I am so HAPPY that Governor Walker left us with a bullet-proof House and Assembly. That alone has stopped so much Socialist BS from advancing.

Nice that he’s taking it straight to Judge Janet, though. It SHOULD backfire; the conservative judges in the WISC will object, for sure. Well, they SHOULD.

Well, I hope they do! ;)

“....pay raises for university employees...?” Aren’t those bass turds already being paid enough? Students can’t even afford to pay their tuition anymore. College tuition is out of control. BIG ED SUCKS!

I absolutely believe he stole both of his elections. Add to that, something needs to be done about the “office” of Superintendent of Public Instruction. Holding elections for it during some obscure time of the year in off-off years has enabled ultraleftist Demonrats to hold it for decades, as Evers held it for a decade before he got “promoted.” The office should be abolished and the Governor should appoint the successor to the job. Something similar with the courts as well. Fix it that the legislature appoints the Justices instead of having the office bought by Communist special interest groups in peculiar off-year elections.

Guess he forgets basic civics and who controls the purse-strings. Evers (and all democrats) should resign since they insist on making up the rules as they go.

I take it the Governor never took civics in High School

Our form of government is there are three separate branches, the Executive, the Courts and the Legislature.

I don’t think the Executive branch can sue the Legislative branch to do anything and the courts have no jurisdiction over the Legislative branch (they can only decide on any laws passed by the branch).

So unless the state constitution allows it, the courts should toss it as the governor has “no standing” to sue.

So he is demanding the legislature agree with him? Or else?

Dummy doesn’t understand basic separation of powers.

That’s rich, since it wasn’t so long ago that the Dems went and hid in Illinois to prevent a quorum.

Paying professors is not a basic government function.

Then the liberal justices can rule impeachment as some type of election/justice interference and make even that illegal (when Republicans do it, that is).

Obviously it should be thrown out due the political question doctrine. Whether it will nor not is another question.

Legislatures control purse strings. Any bill that circles back to Legislature for any level of approval is one that is not fully approved.
So, stick it up your Arse, Guv’na. You should not have signed that bill written as it was. Learn to read.
